Landguard Title Services

Closing appeared to go well. Landguard Title Services and seller were notifed by me of survey encroachment as per contract. Landguard Title declined to reslove at closing. Notified Landguard Title 17 days after closing that seller had not taken care of encroachment and inquired about filing claim on title insurance since the real estate contract outlined encroachments not accepted by me would constitiute a title defect. Jeannie E. Carrier e-mailed back that there would be no claim as encroachment was to be taken care of outside of closing. I requested encroachment be taken care of at closing, Landguard Title declined to resolve at closing and as per the e-mail response, does not intend to now. The money to resolve the encroachment is only $300. I feel fortunate that I did not loose more then that. Update 12-16-13: I filed a complaint with the Florida Department of Financial Services, Divison of Consumer Services. Recieved an update letter. Landguard Title Services failed to respond. During the review, possible regulatory issues were noted and my complaint has been forwarded on to more areas of the Department of Finacial Services
