We hired Allen Byrd to demo a building in front of my wife?s salon. He agreed to do the job for a set price. He later tried to push us off because he found a bigger job. My wife reminded him that he gave us his word with the understanding of the importance of this demo in order to create parking space before the opening at the new location. He told her to pull the permit and agreed to demo the building on Sunday the 18th. I talked to him myself on Friday and he confirmed and said he would be there around 2:00 PM. We moved clients and shut down business for the day for the demo. He did not show. We tried to call him all day and got his voice mail. We left a voice mail asking him to call us. We called many times after that but received a message that the voice mail box was full. We called someone else to do the job. Nick from Break-N-Ground was there the next morning at 0700. Nick asked us if we had an asbestos survey done. We said no, Allen Bryd told us not to worry about it. We don?t know much about this business but thought that since Bryd looked at the property he knew by the age that there was no risk of asbestos or that he was taking care of it. Nick told us to call for a survey. While the new contractor was there Allen Bryd called. He said I noticed you didn?t have an asbestos survey done that?s why I didn?t show on Sunday. I asked him why he did not call us or return our calls. He had no answer. I asked him why he told my wife not to worry about it. He did not answer. He said he would be out later that day. I told him never mind we have someone else. A few minutes later someone called DEP and told them we were tearing down a building without an asbestos survey. We have inside information that it was him. We had already called for a survey as Nick requested and Bryd should have weeks earlier. The survey came back clean but we were forced to wait another 10 days by the DEP. This caused us a lot of trouble and headache. Its not just that he did not show up for the job that he knew was very important to our business or that he did not answer his phone but that he was spiteful when we hired someone else.
