We paid Distinct Design, Inc., the sum of $1,150.00 on October 16, 2013, representing one-half (1/2) the agreed upon contract price to: "Work order to replace 3' moving door. To flash attachment point of length of sunroom. To repair all leaks in existing sunroom." for a total charge of $2,300.00. On November 6, 2013, we received a call that the job was done. That the cause of the leaking was due to the skylights (on the roof) and that same were caulked. This came as a complete surprise as no call was received, either at our home or places of employment, indicating they would be at our home to make the repairs. We inquired as to the flashing and door replacement. The receptionist indicated she would need to check with the design consultant. The receptionist indicated photographs were taken and would be emailed to us. To date, no email or photographs have been received. It should be noted that our yard is fenced and the gates locked. The only way to access the porch was over the roof from the front of the home. The next morning, we climbed on the roof of our home to inspect the alleged work performed. We found no indication of caulking around any skylight or solar tube (there are a total for five on our roof). Further, that caulk had been done across the porch roof where same met the house and roofing tape placed in front of same, a total of 15'. No other caulking or tape were done anywhere else on the porch roof. The only indication that someone had been to our home was a small rolled piece of cardboard placed between the gutter and soffit near the door of the porch. There was no significant amount of caulking or other work performed. That same day we contacted Distinct Design, Inc. The receptionist indicated that the flashing and door would be completed. She indicated she had called the day before with only an update. No further communication was received until we started calling Distinct Design, Inc., on December 9th, 11th, 16th, 18th, 19th, and 20th, 2013, and again, on January 2, 2014. Each time we left messages for return calls regarding the status of the job. On December 20th we spoke with the design consultant. This was the first time since October 11, 2013. He asked if we had received any photographs of the work completed, which we indicated no. The consultant indicated he was having a hard time getting the door. After further discussion, an agreement was reached that no further work would be performed by Distinct Design, Inc., that the consultant would fax or email a revised contact to us that day which would indicate the revised charges for the work, which consisted solely of caulking. We indicated that we believed the work completed should cost substantially less than $1,150.00 which was previously paid to Distinct Design, Inc. The consultant, again, indicated he would get the revised change order to us that day (being December 20, 2013). Another call was placed to Distrinct Design, Inc., on January 2, 2014, regarding the status. The consultant indicated that "Al" would have a contract to us the next day. The next day we placed another call to Distrinct Design, Inc. The consultant indicated he was speaking with "the contractor". We had not been made aware that any contractor or subcontractor would be employed by Distinct Design, Inc., to perform the work. There was no such indication on the contract relating to subbing out the work. We demanded the revised contract to be received that day. Upon arriving home that evening, we located the revised "Change Order' at our front door. The revised "Change Order" indicated: "A change from existing contract written on 10/11/2013. All existing roofing tape replaced. All unions and seams sealed with urethene caulk. As well as skylights. A check in the amount of $300.00 to be returned to customer for changes from original contract. Price includes materials used and labor charges.". We did not accept the revised "Change Order" due to the fact that all existing roofing tape was not replaced. Further, all unions and seams were not sealed with urethene caulk (or any caulk). As well, the skylights were not caulked. A letter was sent to Distinct Design, Inc., by U.S. Certified Return Receipt Mail on January 7, 2014, outling the inconsistencies with the revised "Change Order". The letter stated our concerns, included photographs of the porch roof and skylights, stated what we believed to be a fair amount for the "work" performed, and requesting an immediate refund of $900.00. The letter was received by Distinct Design, Inc., on January 10, 2014. On January 24, 2014, we received an unsigned letter from the receptionist indicating that Distrinct Design, Inc., had spent two (2) days at our home doing the work. The letter included a check for $300.00. Unfortunately, the cost of the filing fees prohibits us from taking this matter to the court system. Therefore, we cannot, under any circumstances, recommend Distinct Design, Inc., a franchise of Four Seasons Sunrooms.
