Mottling is excluded in the SGM warranty. I was not given the SGM warranty (with the exclusionary language) until after the work was completed and payment made. I was provided language on the contract with Tropical Pool Heating that says "Tropical Pool Heating, Inc. is not responsible for cosmetic or structural defects, leaks, cracks, swirl blotches, hollows, lights, ripples, stains in the new plaster or grout??. There are always imperfections to be expected in resurfacing brick & tile replacement, and all other renovations. The only warranty or guarantee is by the product manufacturer, not by Tropical Pool Heating, Inc.".
From this I clearly understand that the product warranty comes from SGM. But there is nothing in the Tropical Pool language, or sales presentation, that suggested to me that I could end up with big black blotches on the bottom of my pool, and that they would not be covered by warranty. The SGM warranty (which I was not given until after job was done and payment tendered) is more specific in its exclusionary language: "ITEMS SPECIFICALLY NOT COVERED BY THIS WARRANTY INCLUDE WITHOUT LIMITATION:?? 5) Naturally occurring color variation, mottling and hydration?.".
But I believe that I should have been advised in very clear language of the very definite possibility of "mottling" and shown the exclusionary language before the contract was signed. I feel the way the whole thing was handled is clearly a deceptive practice, but I'm not sure if the deception is the responsibility of Tropical Pool Heating, or SGM, or both.
I have a real problem with SGM selling a product that will be defective (mottling) in maybe one out of 50 applications. Marketing such a product should not, in my opinion, be allowed without very clear disclosure. Failure to disclose is, in my opinion, tantamount to deception and/or fraud.
"This letter is in response to the Member’s complaint against Tropical Pool Heating, Inc. Tropical Pool Heating resurfaced the Member’s pool with diamond brite on or around May 11, 2012. The pool was filled with water filters and the pool equipment was restarted after pool refilling. The pool water was completely clear and the diamond brite finish was pristine. The Member and myself walked around the pool and inspected the pool for any concerns that the Member my have had. The Member pointed out several areas where there were white spot residues on the deck. I immediately cleaned the areas to his satisfaction. We then treat the pool with muriatic acid (a light chemical start-up), which is the recommended initial start-up recommendations of diamond brite’s manufacturer, Southern Grouts & Mortar (SGM) We then went through the start up procedures with the Member and asked who would be maintaining the pool water chemistry during the curing process. The Member replied that he would be responsible for the pool water maintenance. I told him that it would be wise for him to hire a professional pool service for a start-up and servicing of his swimming pool chemicals. He then stated that he would do the chemical treatments to his pool. When I left the Member’s Property, he was satisfied with the resurfacing of his swimming pool and authorized the final payment on his Visa Card. A few days later, I received a call from the Member. The Member claimed that there was some staining on his pool surface. I went by and took a look at the pool. The Member was not home at the time. After viewing the pool, I did notice some spotting on the pool surface and called into Southern Grouts & Mortar to make a report. Southern Grouts & Mortar’s representative, Scott Knaebel, then made arrangements to go out and look at the Member’s pool. Upon speaking recently with Southern Grouts & Mortar, they are still working with the Member to rectify is pool’s concerns. Since then, Southern Grouts & Mortar has performed two (2) chemical treatments that have reduced the stains according to the Member. But if the Member is still not satisfied, we will call SGM and have them contact the Member for further treatment. As stated in our contract, our warranty to the Member is on the workmanship of our work. The manufacturer, Southern Grouts & Mortar, maintains the warranty of the product. Tropical Pool Heating does not do chemical pool balancing. At the time of inspection and before final payment, the Member, was given a copy of the warranty from Southern Grouts & Mortar and the recommended start-up procedures for his pool. We are providing you a copy of our contract, the back stating our warranty, Southern Grouts & Mortar’s warranty, along with a copy of the recommended start-up procedures for the client. In closing, the structural integrity of the resurfacing is intact. The Member’s concerns are based on surface discoloration of the product. Sincerely, Steven D. Mairano Tropical Pool Heating, Inc"
