The Tile & Stone Market - Fort Myers

When I ordered the tile I explained I had a bad experience with tiles I had ordered from another company. I explained they were way too random and I had exchanged quite a few of them. The tile on display at The Tile & Stone Market was exactly what I was looking for to use in my 2 bathrooms. The tile was a very pretty gray and white swirl pattern. These tiles cost about 4 times more than my other tiles, so my expectations were high for a quality item. I asked if the tiles I would receive would be like those on display. I was told there would be variations. Those on display were all gray and white with random swirls. I asked if my tiles would just be random in the swirl design and not the color. I was told yes. When paying I was told there was a no return policy on special orders. I believe they have no stock in the store and all items are special order. When told this I said, oh you mean I have to be careful and order the correct amount because I cannot return extra tile. He said yes, that is what it means. The tiles I received were not at all like those on display. Of the 2 boxes I opened not even one tile resembled the ones on their display. They were not gray and white, they were more like concrete with dirt splotches. I called and said I wanted to return the tiles. I was told they normally do not offer refunds, but would take them back with a 30% restocking fee. I said this was not acceptable. He then asked if I would like them if they were free. That's when I had my lawyer write a letter. Upon receipt of the letter I was called and told to go ahead and take them to court. He said they dealt with this all the time and they would win, and that I would spend more on legal fees than what I spent on tiles.
