? 12/9/09 Needed sodding work done. Phoned 561-506-8327 - from Craigs List, and was visited by Frank 12/10/09, from Deer Park Environmental. Two 'employees' cleaned up and sprayed weed killer onto my 3,000 square-foot back lawn in preparation for sod-laying. I had purchased the weed killer so they used my materials. When finished, Frank came in to house and discussed the next step and cost. He would purchase the sod instead of my ordering it to save me money on the taxes. Sod per pallet for 3,000 square feet would come to 6 pallets at $89/each - $540. He phoned Myers Sod while here to obtain price and delivery information. ? Frank wrote an 'order' out on his Invoice paper (attached) enumerating the work to be done far and cost for the sod. He requested $725 with balance of $250 payable on completion...... My check #3769 was written to Deer Park Environmental in good faith that this would cover the cost of the sod ? Frank requested that I phone him, even if on weekend, to let him know if the weeds were dead so he could plan to come out and do the sodding. I did phone him on Sunday, Dec. 13, to inform him that the weeds were not yet all dead, and would need an additional treatment. He answered the phone and stated he could access something stronger - industrial weed killer - from a 'friend' - the rains had probably washed away the treatment so it was not completely effective. The next week were severe rains and there was no possibility to do any work on the yard. ? Frank phoned me Monday Dec. 14, said rains caused problems, and that he would get the weed killer from 'friend' and said, "If I have to come out there (to your house) myself on Saturday (the 19th) I'll do so and use the weed killer. Then we'll wait and lay the sod in a week or so...." ? Since Saturday, 12/19, I have made daily phone calls, leaving messages and not leaving messages, erasing my call identity, but he does not answer phone nor call back after being asked to do so. ? I am out $725, check cashed/deposited on the date I paid him the check 12/10, he continues to advertise on Craigs List and does not respond to any phone calls. Since that date, I have 'flagged' his advertisemenst on Craigs List (3 per day) and they are not on there any longer. Today is 1/1/2010.
