My husband and I purchased a large wooden swing set for my 6 year old grandaughter for Christmas. Jeffrey Marks of Marks Brothers Fence & Rail, Inc. was installing a fence at my son's home and I told my son to speak to Jeffrey and ask it he would be interested in building the set for us. Jeffrey said he had built several of them and agreed to do the job. After looking at the set in the packing boxes, he quoted us a price of $525 to $550 and we agreed.
Two partial days into the project Jeffrey found pieces missing. Obviously he had not followed the manufacturer's instructions to do a parts inventory before starting. My son contacted the company and they agreed to ship the parts so they would arrive in two days. At this point Jeffrey asked for a payment for the work that had already been done. Because it was so near Christmas but against better judgment my husband agreed to give him $400 so each workman would have $200 for the weekend. We also agreed that we would pay an additional $50 upon completion because the parts that were missing slowed the guys down from completing the job.
The missing parts arrived as planned on Friday. My son called Jeffrey to tell him the parts were there and to see when he could return to finish the job. Jeffrey informed my son that he would not be coming back to complete the work because he did not feel he could make any money on the job. Jeffrey said he would try to find someone else willing to do the work for the $200 still owed. My son called him numerous times but we have never heard back.
The worst part of this is Jeffrey didn't care that the little 6 year old is heartbroken that her set isn't getting done or how hard it is finding people to work on a partially completed project.
