Leon (the owner) spoke to me on the phone. He asked how many square feet was involved. The employee said they could plant the plants. This was a donation by me to the Church too try and control the weed problem in the beds in front of the school.There was no discussion of price nor cost of planting nor number of plant. I showed up the morning of the job and the work was essentially finished. They had planted over 550 plants. It turns out that the plants were grossly over crowded. Dispite carefully watering, feeding and arduous hand weeding the job enede up a disaster. Many plants were dead, the rest had not "taken" after 2 months. And the weeds were uncontrollable. It was an eyesore in front of the school.Leon sent a bill for $2232.00.I wrote to Leon and asked if we could discuss the price. I saw this as a "failed landscaping job."Leon called me, said he lookes at the site and "didn't see a problem."I wrote again detailing the fact that I surely would not have contracted for 550+ plants, they were over crowded and forwhatever other reasons had failed to grow. He called again and made various claims but refused to accept any responsibility for the job. I never said I wouldn't pay him. I only said that I felt the charges were unfair and requested an adjustment.On July 16th Leon called and threatened the Principal of the school saying that the school would be named in a lawsuit. I received a very stressed call from the parish manager.
Leon had not called me, nor had I received any correspendence from any lawyer. The school had no part in the transaction, this was a donation.To threaten the school was highly unacceptable. I went that night and dug up what was left of the plants, inclusing the dead root balls, and returned them to the nursery.Licensing
