NY.
The contractor initiated labor to secure quick initial and second payment of 3 payments. After second payment he only randomly return to premises and then completely abandoned the job. After two months he returned, promised some work and told us he was overextended on multiple jobs with no resources for staff. We asked him to come then just once a week or even once every two weeks, just for a few hours, so we'd know it would get done. He gave us his word, saying he was a good man who had never done this to anyone before.
He never came back.
The money was given in good faith with time estimate of 1 month to complete the job. We have been lied to about the actions that would be taken. We received windows that were not what was contracted and we learned were installed incorrectly. DMF assured us that the correct windows were being ordered, but they have not come. We are living with open holes in our walls, water coming into our basement and hazardous conditions including open electrical outlets and construction debris. After numerous broken promises, we attempted to contact contractor to communicate that if work was not initiated or attempts to reach were not returned we would file in court. We ultimately had to. Since our filing, he has changed the name of his company to DMFJR Remodeling LLC, compromising our chances for collecting on the settlement.
