The rental tenant that Scott Bayne of Century 21 recommended was not properly vetted. We conducted our own basic investigation of that tenant after she defaulted on her lease agreement by non-payment of rent. Our simple investigation revealed multiple issues with the recommended tenant?s financial integrity. A minimal investigation should have raised red flags in that there are multiple small claims against her in the Connecticut Judicial system for non-payment of debts. If those issues were brought to our attention we would have declined that tenant, but they were not.
We contacted Mr. Bayne in an attempt to get copies of any documents that were obtained or generated as a result of his screening of that tenant so as to determine if due diligence was done to screen the tenant. Mr. Bayne refused to show us anything, even a copy of the rental application. We then requested a refund of the $1200 fee he was paid for that service. Again he refused.
It is evident to us that Mr. Bayne did not properly screen the recommended tenant in the manner that he was contracted to. Regretfully, it appears that we will be forced to file a small claims lawsuit against Scott A. Bayne in order to obtain a refund.
Update:
We filed a complaint with the CT Department of Consumer Protection regarding this matter and an investigation was conducted. The Dept of Consumer Protection, in the investigation of this complaint, requested that Mr. Bayne provide copies of the paperwork generated relating to the screening of the tenant. Mr. Bayne informed them that he shredded that paperwork. The result of The Dept. of Consumer Protection?s investigation is that Mr. Bayne and Bay-Mar Realty violated Section 20-325m of the Connecticut Real Estate Laws and Regulations which requires a real estate broker to retain records for a period of seven years. That (conveniently) shredded paperwork would have been key in their determination of what Mr. Bayne knew about the recommended tenant's financial situation. Bay-Mar Realty was cited for that violation.
