I have filed a complaint with the Southern Colorado BBB because of water damage to my newly refinished oak flooring caused by improper installation of the pedestal sink. On Friday evening, Sep 25th, 2009, I observed that the wood flooring to the left of my pedestal sink and in the adjacent hallway was cupping and separating. Mr O’Connor arrived at my home on Sep 28th and tightened the P-trap fittings to stop the leak. On October 5th, Mr O’Connor left me a voicemail stating that he had filed a claim with his insurance company. I received no further correspondence. I followed up on his October 5th message by contacting and leaving messages with his answering service on October 15th and again on October 16th. I emailed Mr O’Connor on October 19, 2009 to inquire about the claim and received an email response from him on October 19th that he, in fact, did not submit a claim to his insurer because he did not believe the leak from the sink P-trap was the cause of the damage to my wood floor. He has denied responsibility for damage to my floor.
Description of Work: Installation of a pedestal sink and toilet in my powder bathroom on Aug 28, 2009.

As the owner of the company I personally responded to the complaint by the customer. I am a Master Plumber with 31years of experience. (I have video footage and digital pictures of my investigation). The customer’s wood flooring had pre-existing damage to the floor in the powder room that had been recently refinished and our technician had re-installed a pedestal lavatory and a toilet for the customer in the powder room. The technician that installed these fixtures is a third generation Master Plumber with almost 20 years of experience. The customer claimed that the pedestal lavatory had a leak that had ruined the hard wood flooring in the powder room, and as a result the entire wood flooring on the main level wood need to be refinished at our expense. I ran the water in the powder room sink, full force for quite a while before a very slight leak appeared from the pop up assembly’s lever retainer nut. I ran the water for approximately another 10 minutes to see if there was anyway that the small drip could have caused the damage that the customer was complaining about. I took video footage of my investigation which clearly shows that the small dripped that developed after 15-20 minutes of constant water running could not have been responsible for the water damage that the customer is claiming. The customer told me that he has children that use the powder room pedestal lavatory regularly. The pedestal lavatory has no counter, so extreme care has to be taken (which children are not known for) when using pedestal lavatories to not splash water over the edges that spill over onto the floor. The floor all around the pedestal lavatory had pre-existing water damage; that’s why the customer had refinished the wood flooring. The wood flooring had large gaps that the flooring company filled with what appeared to be a type of wood filler, which had obviously, began to shrink and reappear. I have no way of knowing what caused the new damage to the wood flooring in the powder room, but I do know for a certainty that it was not due to the minor leak that I found and fixed. I never had a customer submit a raving review full of praise to Angie’s List before so I was rather surprised by the member's original report. I now believe that the report was a calculated attempt to get TLP to refinish all of his wood flooring at our expense. Due to the current economic downturn there has been a significant increase in homeowners unscrupulously attempting to get Tradesmen to pay for improvements to their homes. TLP in 2009 had at three customers that attempted to unscrupulously have us pay for damage’s that we were not responsible for. Our insurance company denied paying for these fraudulent claims. This member was the third customer to attempt this in 2009, so after much deliberation, I refused to submit his situation to my insurance company. I am a conscientious individual. If I felt that our company was liable for the damages I would not hesitate to file an insurance claim for the resulting damages, However I in good conscience, sincerely believe that our company is not liable, and that the wood floor refinishing job was substandard. However, I will now submit this matter to my insurance company for their review and investigation
