We hired an attorney that informed us that water coming through basement foundations, doors, windows, or roofs as well as rodent infestation is a breech of the habbitability laws of the state. We were released from our lease without an eviction and are now suing for damages.
Description of Work: We rented a house from Mr. Wisehart in West Greeley. He stated that the house and carpets would be professionally cleaned before move-in. We moved in and the house was filthy and the carpets were uncleaned. Two months latter the sprinkler system broke, flooding our basement bedroom. We moved all of our children's bedroom things into the den and had no use of that part of the house for a month. Before that flood was resolved a rainstorm flooded the other bedroom in the basement. When we called Mr. Wisehart to fix it he said, "couldn't you just deal with it?" All the carpet padding was ripped out and he put one small fan in the room to dry out the flood. The dry out took two weeks and mold began to grow. When we reported the mold he did nothing. We sent him a certified letter asking he fix the mold and now new rodent infestation. Twenty days after sending him the letter we got a call from an attorney telling us to fix it ourselves or be evicted.
