Rogers Asphalt Repair

For a $5,000 asphalt repair, I paid $1700 down for materials for him to complete the job. After showing up late in the afternoon and working into the night, he arrived at my doorstep at 10 PM requesting the final $3300 payment. Thinking he had completed the work, my wife paid him. I arrived home minutes later, learned that he had been paid, and called him to tell him that I would be placing a stop-payment on the check as the work was hardly finished. He assured me that he would complete the job, but I've not seen him since. Instead, he cashed the check with a payday loan bank that is holding me responsible for the check despite the stop-payment. I've tried dozens of time to reach Cody Rogers over the last 10 weeks, and even though he acknowledges the deficiency and assures me that I'll be satisfied, he fails to show up to complete the job.
