PJ Brosky co

P.J. Brosky was hired back in May to do some concrete work consisting of a stairway from the sidewalk to the front door along with a retaining wall in the front yard.  In addition he was suppose to poor a extension on the driveway and an extended back patio.  P.J. was paid $7,500,  $3400 of this was on a MasterCard and the remaining $4100 was on Discover Card.  The mistake here was hiring this company.  The issues began when week after week the job was not started.  Every so often a individual would come by and move a little dirt around, take "move measurements" or move a board or 2.  This went on for a month.
Finally the forms got put in place.  Well, sort of as they were not straight, they all were at various angles.  I thought they would correct this before they actually did the poor.  However the poor never happened and thankfully so.
1.) On June 8, 2012 we received a knock at the door from Nate Vialaponda with Platinum Design Roofing at which time he informed us that he was not going to complete the job as P.J. Brosky never paid him.  Rather this is true or not I don't know nor is it my problem. That is between Nate and P.J. Brosky since P.J. subbed this job out to a ROOFING COMPANY.  Regardless I called P.J. Brosky and he acted as though he new nothing about what was going on and tried to blow it off.  This was after MULTIPLE phone calls with no response.  I informed P.J. that his issues with him and his sub contractors are not my problem and that I paid him to do a job and expected it to be completed.  P.J Brosky went on the defense and started asking for additional money.  When he was told "NO" and that I wanted a refund for the amount paid.  He refused.  So I immediately called the credit card companies and stopped payment and put in a dispute.  The good news is the portion paid to the discover card was quickly reversed.  The bad news is P.J still has 3400 that was put on a Master card directly from the bank account.  Since of course debit master cards do not have the same protections as a credit card they have not refunded the money.
2.)  I am now out $3,400 on a concrete job that has NOT been completed.
3.) On Monday 6/11/2012 I received a phone call from my wife stating that Nate Vialponda was here and was very belligerent with her.  She asked him to leave the property and he refused.  I of course was not home and called the police immediately as at this point he was tress passing.  The police showed, however did absolutely NOTHING.  So needless to say CSPD does not rate very high in my book either.  They could have gotten him for tresspassing on private property
4.) We have since learned that P.J. Brosky has had multiple businesses and has actually been on Channel 13 news for doing poor work in the past under the name of Creststone Pavers.  We have also learned the P.J. Brosky is associated with P.J. Brosky LLC, Crestone Builders, Capital Services LLC, and maybe others.
5.) I had 2 other Companies come out and take a look before the forms were removed by Nate Vailapando at Platinum Design Roofing.  Both contractors stated it is a good thing they did not poor as the soil was not compacted properly and the forms were not properly installed.  In fact, both companies stated that in order to do this right, concrete filler would need to be brought in in order to do the job correctly otherwise the concrete would sink and break.
The point here is I'm out $3,400 and looks as though I'll have to deal with the hassle of taking P.J Brosky to court in order to get my money back.
