The contract was signed on September 21, 2010 and my check for $2,100 was cashed on September 23rd. Subsequent attempts to have the builder commit to a work start date were futile. I started contacting the contractor one month after he cashed the check, thinking that it would take a while for the windows to be made. The windows were actually ready 10 days after they were ordered. I sent emails and called the office and was told that Gary had been on a job site, etc, and that he would get back with me next week. Emails directly to Gary were either ignored or replied to with "I should have that nailed down tomorrow" and then no further emails. On November 24th, with no committment as to when my job would be put on his work schedule, I finally called an attorney to see what my options would be. I was advised to contact the local district attorney's office. When I called the DA's office, I was told that I would first have to file a complaint with the police department. This was not a civil legal matter. That same day, I went to the local police substation and the officer contacted Gary directly. Gary was shocked that I'd contacted the police and he said he couldn't believe that I thought he was stealing from me. We finally agreed that he would deliver the windows to my home and I would find someone else to install them since I wanted the work completed in time to qualify for the energy tax credit. It was stated in our contract that the windows would qualify for the tax credit, so there was an understanding that the work had to be completed before December 31st. Gary admitted in our phone conversation at the police station that I had been more than patient to wait a full two months with no committment to a work start date. I believe I could have held him to the contract and subsequently held him responsible if the energy tax credit expired before the window installation was complete, but I really did not want to give this man any more money or have him in my house because he proved himself to be so unreliable. The actual cost of the windows was $2,148.23, so he lost $48.23, but I feel that he got off easy and I had a huge amount if frustration. I was able to find another contractor to install the windows, but my house was in a state of construction until mid December. Fortunately, there were no weather delays. I would never, never, never recommend doing business with this company.
Description of Work: I signed a contract with Gary Roth of Colorado Home Builders on September 21,2010 to install 5 replacement windows in my home. I gave him $2,100 as a downpayment to cover the cost to order the windows. He ordered the windows, which I was eventuallly able to obtain, but the company did not do the installation per our contract. I had to find another contractor to install them.
