Upon completion of work on about 4000 linear feet of wall on the north side of the community DM presented final billing claiming that their work was 100% complete.
DM contract scope (DM paper) indicated 4400 feet of wall "Community Wide". The HOA believed that 4400 feet was the entire community . . . however, about 3300 feet remain to be completed on the south side of the community.
Because of changes in staff at DM and Keystone (HOA property manager), no documentation could be resurected by DM, HOA or Keystone as to initial scope discussions.
The HOA position was that this may have been an honest mistake - DM, HOA and Property Manager should have verified the scope and measurement . . . however, any reasonable person should have understood that the HOA intended scope to cover the entire Community.
DM craftsmanship was acceptable . . . and so HOA hoped to settle the dispute by DM completing the remaining work at DM actual cost without their normal mark-up. In response, DM proposed to complete the work at a significantly higher cost per foot than the original work. HOA estimated this proposal to be about two times DM actual cost.
Based on above (and a subsequent dispute with Keystone for a different HOA) . . . DM has been removed from Keystones list of acceptable bidders.
