BRICKMAN GROUP

The previous owner of the property (a relative of the present owner) passed away in September 2007. Brickman had performed yard maintenance for the prior owner for an extended period of time before September 2007 at a cost in excess of $1,000 per month. After the death of the relative, Brickman asserted that an amount was owing on the account of the prior owner. The alleged debt was disputed by the representative of the estate and the present owner of the property as having been paid. Brickman was informed several times by us, the estate representative, the decedent's bookkeeper and personal assistant and others that the alleged debt was disputed on the basis that that the alleged debt had been fully paid before the decedent's death. The decedent's bookkeeper provided written information to us and to Brickman showing the debt had been paid in full. Regardless, Brickman ignored the information and continued to assert that the disputed debt was owed. We went back and forth with them for months and invited them to sue for it. Rather than make a claim against the decedent's estate or assert a lien of some kind, and attempt to prove the debt was owed, Brickman badgered us for months, trying to collect from us though we had no contract with them. We had never engaged Brickman (Brickman was terminated after the relative's death because of the poor quality of the work they had done on the property.) We recently learned that in 2009 after foregoing any legal or proper way to prove and collect the alleged , Brickman gave Experian negative credit information untruthfully naming us as a debtor on the relative's account.
