"First, We did not perform any services for this customer; we sold him a spa part but did not install it. He installed the circuit board himself when he received it. He stated that he found after installing it that is did not work. If he had not damaged the board by improperly disconnecting it and breaking the connector, we may have been able to send it in for warranty if it was tested and found to be defective. However, he never told us that he had damaged the board, either on hookup or disconnection. See Exhibit A for a picture of the circuit board that we received back from the customer after he had installed it. It is clear to see the damaged connector piece sticking up. He was have noticed it prior to installation also if he had received it that way. He states that we said “the parts that were broken were not included in the box.” This is untrue. The broken part was the part that was clearly sticking up on the board. The damaged area is the area where he would have hooked up his top control panel to, if you pull it out instead of unclipping it you will damage the board, which is what happened. Since he said he did not send a damaged board back to us, we told him that if he thought it was damaged in shipping to us he should file a claim with his shipper. This is all we can do for him since the issue has to do with damage from improper installation and not warranty."
