Dear Mr. Yasher M. or Staff of Angie’s List, Enclosed attachments are as follow: 1) Seven attachments of workmanship & material issues 2) Original & Final 5/10/2018 Guardian Roofs Energy Solution Proposal Agreement 3) Recanting of 40 years material warranty by manufacturer; Edited & Final 5/22/2018 Guardian Roofs Energy Solution Proposal Agreement 4) O’Hagin Vents for 23148……92553; Attic Ventilation Analysis on 4/26/2018 5) O’Hagin Vent Solution for Airway Obstruction 7/12/2018 6) City of Moreno Valley; Correction Notice by Inspector Thomas Arce 6/13/2018 7) Build.com Receipt for three 12” RCX Gravity Ventilators SF purchased 6-12-2018 8) City of Moreno Valley; Final Inspection by Inspector Mike Lungren 7/18/2018 I have been very patience & had compromised from original “Proposal Agreement” (hereinafter as CONTRACT) on May 6, 2018, for the flat roofing system that will give 40 YEAR MATERIAL WARRANTY BY MANUFACTURER & CERTIFIED; however, upon completion of that contract on May 10, 2018, with Mr. Gregg Thompson (hereinafter as Thompson), Contractor Steve L. Sudduth (hereinafter as Sudduth) had altered his CONTRACT for the flat roofing system section. On original contract on 5/6/2018, Sudduth had stated for 40 YEAR MATERIAL WARRANTY BY MANUFACTURER & CERTIFIED then later changed into 10 YEAR by which I did not concurred to that CONTRACT. After several calls from Thompson to finalize this contract and convincing me that their CONTRACT materials will make my home cooler via using radiant barrier foil, several O’Hagin vents on tile roof section and using four (4) whirlybird vents on the flat roof to have a turbine to suck up the hot air inside that flat roof attic; hence, by believing Thompson’s professional roof advises & also Thompson had seen inside my house regarding to the roof & its attached ceilings, I had to compromise so we had agreed for 20 YEAR MATERIAL WARRANTY BY MANUFACTURER & CERTIFIED for the flat roofing system on May 22, 2018, with total price including materials & labors of $14,958. Furthermore, I had clarified to Thompson that I will be checking like President Ronald Regan’s famous motto, “TRUST BUT VERIFY!” Based on the contract the approximated starting date was within two weeks; again I compromised in which Sudduth had to order three rolls of REX Synfelt as the underlayment for roof tiles which will take two weeks then after the arrival of REX Synfelt, Mario Gutierrez (hereinafter as Gutierrez, Project Manager) told me that if they used “Whirlybird” vents I will have to sign a waiver that if there are any leakage due to application of “Whirlybird” vents. This is unbelievable after convincing me to agree on using “Whirlybird” vents to keep my home cool; Mario called Sudduth that there will be an issue of leakage from application of Whirlybird vents----Sudduth called me to use a gravity vents equivalent to “Whirlybird” in dollar amount about $300 due to each 14 inches size of Whirlybird vents was priced at $75 each at Home Depot. I called Thompson that Whirlybird vent cannot be built on the flat roof; Thompson respond that “Yes, you can by building a curve around the Whirlybird vent,” which Gutierrez refused to do. Hence, I had to do research on the internet then found the best gravity vent with longevity of five years with best material & design, which was Soler & Palau 12” CRX Gravity Ventilator Self Flashing ($92.12) then I texted Sudduth with attached photo, who replied via text as “Gravity vents look great for your flat roof.” I ordered online at Build.com which will arrive from 7 to 10 business days. Prior to arrival of three gravity vents, Gutierrez informed me that Dan Hill will begin prior to July 4 of 2018, then I texted Dan Hill on June 23, 2018, that those three gravity vents have arrived. However, the job began on Wednesday 7/11/2018; Gutierrez’s workers (Ruben Zalpa & Carlos Zalpa, cousins to each other) came at 8 AM then I informed them that I will like to see all materials that are to be apply on my roof then Ruben show me the radiant barrier foil rolls & Owen-Corning “Deck Defender,” which I did not agree then I texted Gutierrez and called Thompson that “Deck Defender” was not in the contract; Thompson said, “You will get what you ordered” and upon arrival to my home, Gutierrez said, “there was a miscommunication!” Again, I instructed Gutierrez that I will be following President Ronald Reagan’s motto, “TRUST BUT VERIFY!” After first application of roof material, CertainTeed Glassbase Base Sheet, I will check then continue on the second application, Flintlastic STA Sheet and finally last application will be Flintlastic GTA; likewise I will do the same for the tile roof---radiant barrier foil will be first layer then afterward Rex Synfelt as the underlayment sheets (double). Furthermore, I have informed several times to Ruben Zalpa prior leaving the job site during the evening to swipe the trashes coming down from the roof such as sharp chipped woods, nails, roofing materials & etc. & including of the back entrance of my house; however, Ruben either ignored or did not understand the seriousness by which my dogs as well as myself may step on those dangerous objects (nails & sharp chipped woods) during the evening. Hence, I personally had to clean those trashes on two consecutive days. In addition, on 7-12-2018 genius Ruben Zalpa requested me to get my vehicle out of the garage and somebody left an O’Hagin vent on the driveway for which I accidentally drove over that vent. Now, somebody is accusing of stepping on that vent, but immediately after this incident Ruben & Carlos told me that they will inform ABC roofing supplier that there is one missing O’Hagin vent out of ten (10)O’Hagin vents; now, Sudduth is threatening to charge me for the damage O’Hagin vent. On Thursday 7/12/2018, Building & Safety Inspector, Craig, from City of Moreno Valley came to inspect the roof sheathing in which there were three OSB plywood sheets had been dry rotted and need to be replace. Upon opening & removing those three sheets of dry rot plywood, two were at the tile roof & one was at the flat roof; then we discovered two sides, tile & flat roofs do not have any space for ventilation due to severe obstructions of thick fiberglass insulations between rafters. Immediately, I communicated with O’Hagin Regional Sale Manager, Jacob Carlson (mobile # 916-622-4530 & email
[email protected]), who sent me an email 7-12-2018 with attachment in which the diagram descriptions require to drill three holes of 5/8 inches on top & bottom of each rafter in order to overcome the fiberglass instillation obstruction against airflow. Then, I forwarded that email to Thompson, who never replied that email. Hence, we did not apply any gravity vent & O’Hagin vents on both tile & flat roofs, except on the garage roof section we applied 12 O’Hagin vents as a compromise for Gutierrez’s refusal to make an opening. Since Gutierrez refused to make an opening of 22” x 30” dimension at roof/frame fill area on top of garage roof for required attic access & airflow (opening must remain unobstructed); this task was written on the CONTRACT and stated as “TO BE INSTALLED PER O’HAGIN SPECS FOR YOUR ADDRESS.” Unfortunately, the three S&P RCX gravity vents will not be able to return since at the instruction of Sudduth to spray paint them white with Rust-Oleum brand and deadline for return is within 30 days and from 31 to 60 days will only get store credit. As a contractor, Sudduth had breach his own contract due to the delay and not honoring his verbal recommendation to purchase gravity vents; Sudduth never came to my home but Gregg Thompson had several times! Sudduth had expected me to be an expert regarding to my roof that there are thick insulation on both sides of the roof, which is a nefarious intention by Sudduth so that I will have to swallow the cost of those three S&P 12” RCX gravity vents & its painting cost. Following issues need to be address: 1) Replace the chipped tiles at the valley of the roof 2) Repair all garage OSB plywood sheets that had been painted white in the past now due to many deep long nailing to cause the plywood to split, crack & broken pieces & drywall chipping off pieces; fixing via firstly patching up the damaged areas then paint; also cover or remove material inside the garage so that they will not be painted. 3) Valley tiles are not cut straight by which some are 1.5 inches to 2.0 inches apart from the center. 4) Remove the white paint on the end cap tiles 5) Realign on end cap tiles on the right side at the front house 6) A missing nail on one of the end cap tile at the left side top of the garage 7) Repair unnecessary five holes at eves of the drip edge metal 8) Rain gutter on the flat roof need to be address for none uniformity like the front rain gutter 9) A dent on the O’Hagin vent 10) Repair the crack roof mud next to chimney. 11) Reimburse for those brand new three (3) Soler & Palau 12” RCX Gravity Ventilators with Self Flashing ($296.39) 12) Return credit of $300 for none application of four 14” white aluminum Whirlybird vents according to Guardian Roof Energy Solution Proposal Agreement 13) Reimburse for six Rust-Oleum white spray paint cans ($25.74) 14) Since three (3) OSB plywood sheet were used on roof; in Proposal Agreement ten (10) OSB plywood sheets were prepaid for $320; return credit of seven sheets at $32 each will be $224 15) Twenty (20) years CertainTeed System Warranty certification addressing to 23148 Surtees Court, Moreno Valley, CA 92553 and including of dating about July 2018 All these issues must be resolve amicably prior to the payment of $14,115.48 Respectfully yours, William K.
