About four hours after he arrived he called saying he could not complete the job because he wasn't feeling well. He said he would return all but $50 of my deposit and leave it in a designated location. Several days later when I arrived at the house, there was no refund of my deposit. At this point I am out my deposit and have not had any painting done. I may have to file a claim in small claims court to recover.

"As stated by the member, I did arrive at the house fully prepared to start the job and so cashed the deposit check in order to purchase the required materials. Upon arriving back, my health took an immediate downturn (doctors tests and results are available) and I knew my nephew could not do justice to the job alone. I contacted the member and told him in all good father I could not continue the job as I knew I wouldn't be able to give it 100%. I have been in this business in this valley for 35 years. I never give less than my all on a job and didn't build a reputation for perfection by doing shoddy work or being less than honorable. During the phone call to the member several alternatives were discussed in how to return the money and was agreed on by BOTH parties on a place to leave the key and money. What the member has neglected to say in his report is that when he returned home, he found his house "broken into" having a stone/brick thrown through the window. He claims to have filed a police report of which I have still not seen a copy of. I understand his frustration of having lost his deposit but no not see how my reputation and name should be besmirched for something I was not responsible for. Had the member agreed to leave the money where it was , which is a verbal agreement just as valid as any written agreement, we could have avoided this by me mailing him a check or meeting him when he returned to town."
