On December 23, 2008, I used a third party website to research mortgage refinancing mortgage rates. I was contacted by phone by a rep the same day. He emailed me with appealing rates and a good faith estimate. The final information that I signed and faxed to approve indicated an interest rate of 4.625% for a 30-year fixed mortgage with $5,943.08 in closing costs for a $360,000 mortgage. The rep indicated over the phone that closing would be approximately 3 weeks out. On December 30, 2008, an appraiser came to our property, and I paid him out of pocket in the amount of $350.00. On January 6, 2009, the rep indicated in an email to me that the appraisal invoice was "unpaid." I emailed a scan of the canceled check on the same day to show that it had in fact been paid and already cleared. January 9, 2009 I checked on the status and the rep indicated that "Everything is in line and in underwriting." January 19, 2009 I checked on the status via email again and received no reply. February 4, 2009, I received a call at work from the rep's cell phone indicating that the loan was approved and the interest rate would be 4.875% with a buy-down (of an undisclosed amount). I told him that I would not agree to a buy-down. He told me that they would "waive the origination fee" to offset the buy-down, so I agreed. He told me that we would receive a call from a notary to set up closing. February 9, 2009, I received a call from the notary to set up closing that evening. At closing, the notary was extremely rude and rushed us through the paperwork, despite my protests and wishes to correct things that were incorrect. She assured my husband and me that things would be corrected by the bank. Closing fees ended up being $11,860.28, and the buy-down was not offset as promised. Late February, Early March, we received a check from the bank in the amount of $982.57 for the "cash out." None of the items were corrected as promised (not even the spelling of our names). March 9, 2009, I emailed the rep and asked him to respond in writing about the hidden fees and lack of buy-down offset. His response did not answer my issues: "The major difference were your interest amounts and payoffs our origination (cross line's fees) did not change, except for the fact that we discounted it to assist in buying down the rate." Note: There were NO discounts on the origination fees. I received a phone message from the rep's supervisor followed by an email on March 13 asking me to call him. I replied on March 24, 2009 asking him to reply to my concerns via email (IN WRITING) by Friday, March 27, 2009. I received no response.
