Background info: A general contractor, Steven ?Shane? Salyers of Salyers & Sons, that we hired for a home renovation abandoned the project halfway through and kept the money that we paid him in advance. He also did not pay his subcontractors. Scott Waste was one of those subcontractors. We called the Scott and asked him to remove the dumpster the day after we gave up on Shane ever following through on the work. Scott Waste?s owner, Scott, said that Shane's credit card was declined early on, but Scott continued to empty the dumpster several times and run up the bill until we called. We had no way of knowing that Shane wasn?t paying his subcontractors with the huge amount of money we gave him. Scott said he would not remove the dumpster unless we paid the bill of $1700. He tried to convince us to pay $1050 the first time we called, then $825 the second time we called. He called us "pathetic" and threatened to leave the dumpster blocking our driveway indefinitely until we "made him an offer." We were concerned that when he came to retrieve his dumpster, he would dump the contents on our property instead of removing and disposing of it ? now we know the rumors are true. And based on the contents of the dumpster we doubt that it was emptied several times, as Scott stated; maybe once.
His service agreement is with Shane Salyers and we paid Shane 10s of thousands of dollars for incomplete work (and some work that will need to be redone), including $1800 for dumpsters. Under Arizona law (A.R.S. 33-981 and 33-1002) Scott did not have a legal claim against us or our property. However, he does have the option to sue the contractor, Shane, to collect the
debt owed. Or he could use Angie?s mediation services. We have no idea whether Shane paid Scott and Scott just wanted to try to get more money out of us. With no legal claim against us, he essentially resorted to extortion instead of doing the right thing,
cutting his losses, collecting the dumpster, and pursuing proper legal action against the contractor he had an agreement with (just like we have to do).
