owner/operator Wade Gillespie wrote me a contract to repair damage from a small leak in an outer kitchen wall, which was apparently due to incorrect placement of gutters by another contractor. (The gutter contractor has agreed to correct the gutter placement at no cost even though their warranty had expired). Gillespie said cost would be $900, with $450 down to cost of materials, which he specified in the contract as 2 sheets 4x8x5x8 sheetrock, 1 tub Bcadex, 1v roll mesh type, 3 cans of orange peel knock down texture, 2 gallons of gloss paint, white. The job description read "first day will come in take down cabinets and sheet rock and replace damaged areas in kitchen. Then will replace with new. Then will type ad mud joints. And will spray texture on ceiling. 2nd day will come back in apply paint and take all debris away from job site. Should take 2 to 3 days for completion of project."Gillespie was supposed to begin the work on Sunday, May 13 but he could not get his truck started, because of a malfunctioning breathalyzer he was required to use because of a DUI conviction. He asked another contractor to come instead. The other contractor looked at the damage and said the damage could be repaired by scraping a small area of the wall where the water had leaked into the wall, an area about eight inches deep and three feet wide. This contractor scraped the area, mudded it, and said Gillespie could sand and paint it when it was done. Gillespie showed up on May 16 with a helper, whom he instructed to sand and paint. I was busy working at my kitchen table and when I turned around I found this helper was painting not only the ceiling, which was in the contract, but the kitchen walls. He had moved things off of the counter and was half way done. I told him I was not paying to paint the walls and he should call the contractor but since he had painted half of the walls already, he should finish up. (Later I realized they had used the wrong paint, a white gloss that did not match the wall, nor the adjoining dining area, so I will have to repaint the kitchen walls.)When Gillespie arrived, he walked in and said "where's my money?" He insisted that he had told me the walls had to be painted to match the ceiling. WE HAD NEVER DISCUSSED PAINTING KITCHEN WALLS. He spoke in a loud, threatening voice and said he would not leave until he got another $450. I refused to give him any more money, since he had not even done $450 in work, and of the supplies he said he had to purchase, he had a small amount of mud and half a gallon of paint. He finally stormed out of the house, slamming doors and threatening to call the state troopers. I feel that the work done was worth maybe $250 and want a refund of $200.
Description of Work: because owner/operator was unable to arrive at the agreed upon time, Sunday, May 13, he sent another contractor, who said the work Gillespie described in his contract was NOT necessary. The second contractor scraped the mudded a small section of the wall of the kitchen between the ceiling and top of the kitchen window. The area is about 8 inches high and three feet wide.On Wednesday, May 16, Gillespie arrived with a helper, whom he instructed to sand the mudded area and paint. I assumed that Gillespie now realized that the work described in his contract was far greater than that needed for repair of the kitchen, and would give me a refund. While I was working at my kitchen table with my back turned to him, the helper finished sanding and I assumed he was painting the ceiling. When I looked up from my work at the computer and removed my earphones and turned, he was painting the kitchen walls, which was not part of the contract. I told him that since he had painted half the walls he had better finish them but I was not paying for painting the walls. He had not finished when Gillespie arrived, rudely demanding $450 in addition to the $450 down I had paid for supplies he said were needed. He was loud, rude, totally unprofessional and left saying he was calling the state troopers and wasn't going to leave my property until they came. He did leave, but he took all the supplies I had paid for with him, including one and a half gallons of paint that was not used. I asked the helper how much paint he used for the walls that he did not finish, and the ceiling. The helper showed me the paint can he was using and said he used half a gallon of paint in all.
