Before the project started, I ask Ryan (contractor) and Kelly (project manager) if I required a permit. I was told only 'structural' jobs required permits and this was not considered structrual. When I went to fix the mess, I found out that a permit had been required. I trusted my contractor to give me accurate information. Ryan did not enclose the construction area in any way. There was concrete dust and chunks throughout the entire house which damaged my furnace. He also cut through the duct work in two places. With the type of ducts I had, they had to be supported during excavation or they could cause cave-ins through out the entire system. Cave-in were cause in 3 other areas. Ryan did not take any precautions. When Ryan removed the toilet he did not cap the standpipe. My area flooded and I wound up with raw sewage in the construction area which then followed the pipe line into the crawl space. I was in contact with Kelly though out and finally stopped the project until we could get some resolution. Her solution was to ask if have Ryan put up plastic at that point and to hire a cleaning crew at the end of the project would I let the project continue. I gave her an itemized list of what needed to be done before the project could resume. Ryan came and pick up his tools and left. No debris pickup was ever done. Kelly stopped communicating with me. I called their insurance agent (Auto Owners Insurance Co.) Several weeks later I got cc:'d on a letter from their insurance carrier to Avondale stating that Handyman Remodeling Services LLC had subcontracted the work out to Avondale Customs, Inc. and that they had a hold-harmless clause with them. So they claimed they were not responsible. This was the first time I found out Ryan was a subcontractor. Avondale's insurance company, Country Financial, was cc:'d on the letter and I contacted them. They claim I didn't have a contract with Avondale Customs, Inc so they were not responsible and"In, addition, please be advised that our insured's policy exlcudes his work, therefore, any property damage you are claiming that is related to work performed by our insured is excluded by the policy." that Avondale didn't have insurance to cover this type of claim. I went back to Handyman's insurance company and was told they would not talk to me unless I hired an attorney and had the attorney contact them. I have tried diligently to find an attorney to handle this, but so far no luck because their physical location is out of state even though they are listed on Cyberdrive Illnois. Their website states "3. Are you Insured and Bonded? Yes, we are, and this is extremely important because it protects you, the homeowner. If a craftsman is not insured or bonded, you could be responsible for workers compensation and medical costs if they were to get hurt on your premises." Email I received from Kelly with the quote states "-we are fully insured," When I hired another contractor to fix the mess, I found out that Ryan had only left a 12' space for the shower door to open. Even if I wasn't handicapped, that is an unrealistic opening. Obviously Ryan had no idea what he was doing throughout the project. I have gotten most of the money I paid them back. However, when I went to return the supplies purchased, over $300 of merchandizing was missing and I did not get back my deposits. I spent $21,508 fixing the damages they did. ALL of the damages could have been avoided if Ryan had taken proper precautions and not taken a job he did not have the expertise to do.. I am a senior on social security. That $21,508 was a big chunk of my savings. .
Description of Work: he was hired to remove bathroom fixtures, repair subfloor, install new vinyl tiles, and replace fixtures. He was also to knock door wall between closet and bathroom and install a shower. When the tiles were removed, we found out we were on a slab and it required updating the contract to include: "Break out cement floor as necessary to route new drain, Relocate heating vent, attach Tee to 2" waste & run 1/2" copper supply lines. The cement is over 8" thick, reinforced with steel re bar and existing copper supply lines and vent duct work are set in this and need to be carefully removed in order to make the required connections and relocation. Pour new concrete to fill voids and uneven areas. The cost of service include labor only...I needed to supply all materials.

Scope of Work: February 28, 2013 – We collected a progress payment from [member name removed] on the bathroom project we had been working on at her home. At that time, she informed us that everything was going well and she was happy. March 3, 2013 - [member name removed] sent an email letting us know that her furnace was not working which she believed was a result of dust from when Ryan (the subcontractor) was removing the concrete shower pan and not covering the cold air exchange vent in the bathroom. (FYI- Ryan had applied plastic to the door opening and the floor heat vent to keep dust contained) During the course of the next week – We spoke with [member name removed] several times about various options to compensate her and/or pay to have her furnace cleaned directly. As the week progressed however, She informed us of more and more “damages” that she believed Ryan was responsible for, including, her air conditioner not working (not sure how anyone would know this in March) and that there were now large amounts of dust through out her house. March 9, 2013 – Unbeknownst to us, [member name removed] contact our insurance agent to file a claim for damages she occurred to her health and her property. At that point, under the advice of our insurance agent, we stopped communicating with [member name removed] because of the fact that she has initiated a claim against us. At this point it was now up to the insurance company to sort out the details of her complaint. After the insurance company’s completed their investigation they informed both [member name removed] and us, that [member name removed] did not have a valid claim. March 18, 2013 – We received an email from [member name removed] stating “I have also contacted Bennett Baker, esp. with the firm of Goldberg, Weisman, and Cairo. After explaining the amount of concrete dust and pebbles in the heat exchanger and in the ductwork, I have been advised to have a check x-ray to determine how much concrete I have inhaled. Medical issues may also need to be addressed.” The attorney she mentions has never contacted us and we not received any correspondence/contact from [member name removed] since that last email on March 18, 2013. Addressing Insurance and Subcontractor Concerns: Handyman Remodeling Services is insured and bonded. (See Attached) Our organization is set up such that we subcontract out the labor on our projects and we require our subcontractors to hold a valid insurance certificate for their business as well. Ryan drove his own business truck gave her his own business number which she used to contact him and left several messages on his phone which identifies him and his business, not Handyman’s. [member name removed] met with Ryan, several times during the quote process of this project. [member name removed] and Ryan formed a relationship and [member name removed] ultimately decided to have Ryan do this job. [member name removed] made the decision to do this Project with Ryan. I am not sure what her claim of being dishonest that Ryan is a subcontractor and that Ryan was not the guy to do the job comes from. Addressing Permits: The contract that [member name removed] accepted clearly states in the terms and conditions the following “The customer will obtain and pay for all permits, licenses and inspections required for work on this contract. Handyman Remodeling Services/craftsman is not responsible for any associated damages or costs.” Handyman Remodeling or our subcontractors do not pull permits and it is the customer responsibility to contact their municipality for information pertaining to permits and their projects. We are more then happy to assist in the permit process, and have done so many times. But it is the responsibility of the homeowner to acquire the necessary permits for work to be done on their home. Summary: Replying to this complaint is a difficult matter for us. Certainly, [member name removed] did not have a good experience working with our company and that is extremely disappointing for us. We want every job to go perfect and when it does not we take that seriously. We do everything in our power to make it right, because let’s be honest, not ever project goes perfect. We know that and get that. The important thing is what is done to correct the issue. We take that very seriously. The difficulty we have in this situation is that once we were aware of [member name removed] concerns about her furnace we were in conversation with her to develop a go forward plan to complete the project and resolve any and every extenuating issue. It was our impression that we were moving forward so when we learned that she filed a claim for damages (on health and property issues that she had not even shared with us) without insurance company it was completely shocking. At that time we have to be hands off as the insurance company now takes over. [member name removed] then states that she had to spend $21, 508 to repair and complete the project at her home. I am not sure if that is accurate or not for we have no received any information/correspondence from her since March, 2013. We would sure like to see what that is, invoices, etc. If that is the issues, we would want to keep in the loop. What I know is that we were in the progress of working through her issues, and then we get blindsided with an insurance situation. Once that happens we have to be hands off and let the insurance company take over. After an insurance investigation denies [member name removed] claim and says it was invalid, she then contacts an attorney and he also does nothing. Now a year later she puts out a very negative review. I am not sure how or what we could have done different. I believe we did the job the correct way following the correct procedure. I believe once we were alerted to any possible issue, we jumped on it and took it very serious and were in the process of solving with her. In the end, this got pulled out of our hands because of the direction [member name removed] took it and she is obviously unhappy with what the insurance company and her attorney’s conclusion as well and now is going to Angies List and writing a negative review on our company without any supporting documentation and obviously no other credible recourse. I have and will always stand behind everything we do. If there is a mistake, I will do everything in my power to correct it. I think [member name removed] is looking for something here that is not right.
