I called them and told them this is misrepresentation. They told me that I should have gone to a store to check it out first. They kept telling me what I should have done, instead of what they could do for me. They told me that they will come back to pick it up but I would be charged an extra $300. I even told them that I would purchase another set of furniture that I checked on and liked and they would just need to exchange them, but they said no I would still need to pay $300. I am very disappointed in their customer service. The tags are still on the chairs because I have not used them.
Description of Work: They had a really good deal on their furniture. They called the color that I really liked “Mocha” but when I got it, the color was way off. The color is actually a dark chocolate brown vs a light mocha.

We are very sorry that the member is unhappy with the color of the chairs. The picture of the set is the exact same set that we sent. We sent the pictures over, and they said it is the correct color. The Chairs and Ottoman are made with a chenille fabric. This fabric reflects light differently depending on the amount of light in the room, the angle at which the light hits the fabric, and the angle at which the fabric is viewed. The pictures on our website show the Chair and Ottoman in a photography studio where the lighting may be different than what is in her home. Every customer’s lighting is different, and that is why the set looks like a different color to her. Additionally, if we sent the wrong color it was the member’s responsibility to “inspect the merchandise at the time of delivery and refuse the delivery”, if she expected us to pay for it. That language is in the check out process, and not in small print. It the first thing you see on the confirmation page, and then we email you a confirm letter saying the same thing. A customer can not miss these instructions, it’s glaringly obvious. It’s in the first 3 messages immediately after purchase. The reason we have this policy is it costs us that extra $300 to send a delivery truck back to her house. She even admits that she knew she did not like the color at the time of delivery, and yet she kept the set anyway. You cannot check out with agreeing to our terms, and they are as clear as day right in front of you, when you click the box “I agree” directly next to the box is a small paragraph here is the exact paragraph she agreed to: “Our limited warranty guarantees to restore or replace (at our discretion) your brand new, direct from the factory furniture to factory standards if there are any damages or defects, as is standard for the industry. All damaged, defective, or wrong items, must be noted on the bill of lading and refused at the time of delivery, or Home Gallery will not be responsible to cure your damaged, defective, or wrong item.” She may return the merchandise under our 30 day return policy, which means she has to pour our round trip shipping cost.
