"We are very sorry to hear that you are so disappointed. However, let me clarify some of the accusations you are making against our company. First, as you mentioned, this was a disaster event. A catastrophic event that not only affected our area but our entire state and 14 others. During a pandemic no less. There were so many people needing services during this time, that several companies just quit answering their phones. You were referred to us so we felt a responsibility to do what we could to help. For emergency mitigation services hardly any company, if any, can give you an accurate estimate prior to the work being performed. There are too many variables. The $1500 deposit was a fair amount. We started this job on good faith that we would be paid for the services provided. The deposit was simply a means for us to maintain cash flow through a difficult time. With the extreme workload at that time, we had to rely on our sub-contractors to provide labor on several projects, yours being one of them. These were not day laborers pulled off the streets, many were family members of the sub-contractors pitching in to help. All of our employees and our sub-contractors were working 80-hour work weeks or more, for several weeks. Drying equipment had to be trucked in and rented at a higher rate due to supply and demand as well as transportation costs. Given the extreme workload, mistakes were made. When it was pointed out that an item had been double-billed, it was immediately corrected. Our charges reflected the extra expenses of the rental equipment, transport of the same and the fact that ALL our workers were working extreme overtime. Those items and others add to the cost of services, over and above what a standard rate would be. Your insurance company chose to send your file to a 3rd party company whose sole purpose was to undercut the invoices from mitigation companies. This was done industry-wide by a company that has one of the worst reputations among contractors in the industry. These actions bordered on price-fixing. When we still had not been paid after 90 days, we did what any company would do and began to take steps to protect our interest. A lien was not filed. An intent to lien was filed. The dates these documents are required are set by the State of Texas, not us. We ultimately had a choice: accept the insurance company low-ball offer or come after you. We chose to accept their offer rather than hold you responsible for the difference."
