Rock Foundation Repair

On May 5, 2015 I made contact with Rock Foundation Repair off of craigslist and had them come out to give me a free estimate on some foundation work. A Mr. Valente Acevedo and his sister Miss. Silvia Mendoza showed up to give me the estimate. Miss Mendoza was there to translate to Mr. Acevedo because he spoke broken english. I was presented three options one was for reshiming the house $2150, next one installing eight cone piers with 68ft. of beams $3750 and last reshim house install sixteen cone piers and 68ft. of beams $7950. Mr. Acevedo informed me that the $7950 was the best way to go because it was going to offer better support and the house wouldn't move. I told them I would get back to them that i was taken bids and estimates. After going though all the bids Mr. Acevedo bid was the highest one and detailed a lot more work and piers and bracing with beams. I contacted Miss. Mendoza and informed her that it seems like your bothers plan of action made since and would like to see what the best price would be and she said let me see and I will check and get back with you. She called me back later that day and said that they could do everything for $7500. I told her when can you start she said the workers will be there May 18, 2015 at 9:00 am ready to start. Mr. Acevedo showed up with his workers and dropped off materals and collected half of the money $3750. His workers were left unattended the three days working on my house and never seen Mr. Acevedo till May 20, 2015 to collect the other half $3750. About a month later sometime in June I contacted Miss Mendoza and informed her that the house was having a lot of cracks and movement and the back door was not shutting properly. She said her and Mr. Acevedo would come out and make some adjustments. They showed up a few days later and made some adjustments and left. A week went by and still the house was having problems I called them again and they came out and made adjustments and left. Finally in July the house is having major problems doors are not closing right the back door is stuck closed and my whole house is cracking every where walls and ceiling. My wife contacted Miss Mendoza and informed her what was going on and that if they can not fix the problems we need to be refunded all the money back or we are going to seek legal proceedings. She said she would talk to Mr. Acevedo about a refund. But in the mean time no one would be able to come out for three weeks. So on July 24, 2015 I called out a structural engineer to see what was going on. A Mr. Nick Manesh with NME Structural Engineering came out to do the inspection. After he had checked out the foundation he said I hate to inform you of the bad news but you have been scammed, every one of the piers that was installed had failed (sunk) and all the work that was performed was very poor and the warranty was useless. He asked me how many days the workers where here and I told him three days. He said that is not enough time for the concrete to dry up. He informed me that dry time would need to be at least one week and also the piers are not deep enough in the ground to shallow.He stated that the little companies do not have the right equipment to be doing foundation work in this state. None of the work is up to standarders. He said that with this report I could file a law suit to get my money refunded back if I couldn't get a refund from Rock Foundation. I called Miss Mendoza and informed her that a engineer found that all the piers have failed and that all the work was very questinable she said email me the report. I contacted her back and she said her bother(Mr. Acevedo) was out of town in Oklahoma and would not be back till August 12, 2015 to address the problems. They sent one of there workers out to get the back door open and till Mr. Acevedo came back out. I had my real estate agent call Mr. Acevedo on his cell phone for a free estimate on a house and he came out for him the next day so how can he be out of town for three weeks. On August 11, 2015 Mr. Acevedo and Miss Mendoza showed up at my house and was tring to refund me $4500 and wanted to keep $3500 for materals and labor at that time i refused it and wanted a full refund of $7500. At that time they said they would refund the $7500 but they were taking the materals under the house after that they said they would be back at a later date to get the materals and I informed him that the house would have to be put back the same way it was before he started his work. I had three foundation companies come out and inspect and said the job was very poor workmanship and not done right and said that if Rock Foundation came out and took out materals that they would not be able to put it back the way it was and it would cause a lot of damage to the house. I called the engineer and informed him about Rock Foundation wanting to come out and take all the materals out and he informed me that they can not do that because they have failed to do the work right and if they take it out it will CAUSE MAJOR DAMAGE TO HOUSE. My wife called Mr. Acevedo and informed him that what the engineer said and he said he wanted $3500 for materals and labor, she tried to explain to him that the job was not done right and we do not want you on are property anymore to cause anymore damage and he hung up the phone. I recieved a letter from Rock Foundation on August 22, 2015 threatening legal action for $3750 if I dont pay. This company hires illegal undocumented workers and they wonder why the work is not done right. I will be contacting ICE and inform them of there illegal actives. And will be seeking damages for my house and making sure this people are run out of business.
