Ernie had been mowing my yard for two years and I never had a problem until...(yes, this is long but you should read how he tried to take advantage; especially if you are a woman.)
I verbally indicated (over the phone) that he would have the job, saying "Once I receive the contract this afternoon, it appears the job is yours." Before I had signed the contract, even before Ernie Ochoa (the owner) had sent me the contract, he called to tell me he had sent a crew to my house to do some early prep work. While on the phone with Ernie, I received a text message from my neighbor. It was a picture of my chopped down Mountain Laurel. His crew had cut down the wrong tree! (I'll let you imagine my anger.) His response was that he would replace with similar size. This was a $1000 tree he'd just killed. But, since I had history with Ernie, I let him proceed with the sod/mulch job. They began laying the sod right on top of my old hard dirt. I had to call Ernie to get them to "rough up" the ground. Three days later they laid down the mulch. I came home from work and checked underneath and there was no weed block. I had an email confirmation from him assuring me there would be two layers of commercial grade weed block under the mulch. When Ernie showed up the next day and I pointed out the absence of weed block he told me "oh, they used a liquid weed block. It's very good and you didn't have any weeds growing in the mulch area anyway so you don't have to worry." I was shocked that he would think I'd believe that. To press him, I said "So we just had a misunderstanding of the definition of two layers of commercial grade weed block, as stated in the contract?" and he actually said "yes". Two days later I contacted him and told him he was going to have to lay down the weed block per the contract since that is what I'd paid for. I finally got the weed block seven weeks later.
The contract was 1/2 down at start and the balance due at job completion. Ernie charged the second half once the mulch was installed, but he never let me know he was doing this. I found out when my credit card notified me. I tried to reach Ernie, who was always prompt responding via text message, but I couldn't reach him. Late that night I texted him that I had no choice but to file a dispute with my credit card because the job was not complete until the weed block was installed. It turned out that Ernie had been in a car wreck and had spent the night at the hospital.
Throughout all this time, I kept asking Ernie to send me pictures of the replacement Mountain Laurel. I did not think his version of a pretty tree would be the same as mine. I offered to meet him at the tree farm, but he said I was not allowed on the premises. He sent pictures of a few trees, but they were all very small and at the most maybe 2 inch diameter. My tree was 8 inch diameter. Ernie said he could not replace with a tree anywhere near the size that was cut down, that he just couldn't afford it. I had specifically asked at the beginning of the project if he had insurance coverage and he showed me a certificate, saying he had to be covered due to his commercial side of the business. I don't know why he couldn't replace similar size, as he said he would at the beginning.
The day the weed block was finally installed, eight weeks after the project began, Ernie realized my credit card company had withheld his charge for the balance of the project. He called me and proceeded to cuss and whine about not being able to buy anything and was being charged NSF fees right and left. He even asked me to write him another check to help him out. I told him the funds would be released at completion of the job (per the contract) and the job was being completed as we spoke. He called back repeatedly that morning with more whining about not being able to buy anything. He said he was going to have his lawyer sue me for all his NSF fees. He told me he would no longer mow my yard; I'd have to find some other company. Then he said he couldn't finish my job because the crew had run out of weed block and he couldn't buy more. I told him I would call the company he was going to buy the weed block from and charge it to my card and his crew could pick it up since they were near the place having lunch. I called and gave my card information and the crew returned from lunch with more weed block and finished the job. I immediately called my credit card company and told them to release the funds. Upon inspection of the weed block, I realized it was inferior to the original weed block that had been used. I called the business back to confirm the final cost and to request a copy of the receipt. The person on the phone said no one had been by yet to pick up the weed block, that Ernie had told them he would be by later that day or the next morning to pick it up. So I just bought Ernie $85 worth of weed block that was never used on my property.
Replacement Mountain Laurel? Not gonna happen. I'm out a $1000 tree. I say Ernie is a P***.
