WATERMARK REAL ESTATE

Watermark has been our property management company for two years as of the end of this year of 2011. For 1.5 of those years, I was the Treasurer on the HOA's Board.  Watermark's oversight was severely lacking in many areas:
1) The property manager did not, on a consistent basis, walk or inspect the property for burnt out lights, torn up landscaping, animal feces, trash left on front porches, etc.; 2) The property manager did not properly oversee outside contractors who made costly repairs; resulting in reworks of the repairs and costing the Homeowners 2 to 3 times what the original repair should have cost; 3) The property manager and his manager was not, on numerous occasions, responsive or available to Homeowner and/or Board concerns; 4) The financials from Watermark contained numerous mistakes of double billing, paying other Association's invoices with our money and bank reconciliations that did not tie to the cash on hand in the Association's banking accounts; 5) Upon his own recognizance, the property manager overturned the Board's wishes and/or the Rules they had put in place in order to forgive delinquent Homeowners for fees owed from paying dues several months late. The property manager also refused, on various occasions, to enforce the Rules of the Association, making "exceptions" for various Homeowners, which was not in the best interest of the general Association and against the Bylaws or the Declaration; and 6) The property manager has been unable or unwilling to provide a minimum of 36 inches of accessible routing around the property, as dictated under Section 401 of the American Disabilities Act, Title II and III.
