We were not present at the closing, so we requested that a wire transfer be made to our bank. The funds did not show up in our account until we contacted OUR real estate agent, to inquire as to what happened to the money. She was told that there was a problem with the transfer and it was rejected by our bank. Our bank told us that the account number and our names were input incorrectly, so they could not match to our account or any other account in the bank. We re-sent the closing instructions (same PDF document we had provided BEFORE the closing) and the closing agent put in the transfer again, this time correctly inputting the account number and names and the money was in the account within minutes, but 5 business day AFTER it should have been there. Colony claims that their bank did not notify them that there was a problem, and that Colony receives and transmits many wire transfers every day. FUNNY that they did not notice over $263,000 that was credited back to their account without a matching transaction! It is obvious that this a business which does not apply normal due diligence with regard its fiduciary responsibilities to make sure that the information used to transmit OTHER PEOPLE's MONEY is accurately input into the wire transfer system. We emailed the president of the company twice. She has not answered us. The employee who made the errors answered the first email. After filing a complaint with the Better Business Bureau (BBB), we received a copy of the response from Colony to the BBB. Again, Colony says their bank did not notify them, and they did not know that the transfer had been returned. They claim they made an "honest mistake." If they are handling hundred's of thousands of dollars of other people's money there is an implied, if not legal responsibility to take adequate steps to insure that information is input correctly. We told the BBB we wanted a a written apology from the president of Colony and the $7.69 in lost interest. The response from Colony's president made reference to an apology from the employee who made the error, but she neither apologized herself, nor addressed the interest in her response.
