"Eagle Land Title Agency has been in business almost 40 years and has closed thousands of real estate transactions. The reviews on Angie's List attest to the quality of our work and customer service. Each and every transaction is unique, some more than others, but each deserves and receives our personal attention. In this particular case, we were asked to assist in the sale within a family. The contract, being only 9 lines, was probably the shortest and most minimal contract we have ever seen; by comparison, the standard contract approved by the Columbus Bar Association and the Columbus Realtors is 13 pages in length. Although she states in the review that the lender approved it, she did not reveal that to us. Furthermore, lenders are in the business of lending money, not protecting the interests of buyers and sellers. We as title agents do not represent buyers or sellers, we provide title insurance and closing services. We suggested that the buyer consult with an attorney, which is always a good idea when doing a real estate transaction of any kind and especially for someone who is out of state and will not be attending the closing in person. One of the facts which the buyer did not provide in our first call. Within 48 hours of our first phone call, we provided the buyer with an estimate of the charges involved in closing the transaction. While we have no problem providing prospective buyers and sellers with advice and information for no charge, at the point where we were going to incur some significant out of pocket expenses, we requested that the buyer approve the estimated charges and provide $500 to cover the anticipated expenses, which she did not do. In most cases we do not require up front payments, however, in this case we were dealing with a buyer from California who would not be attending the closing here in Ohio and presented more than the usual financial risk for our company as there were no local real estate brokers or attorneys involved, thus the request for the $500. As she states in the review, she did not reveal all the pertinent facts in our initial call and that it took several days until all the relevant facts of the situation were known to us. We have been in business for almost 40 years in the Central Ohio market and have learned over the years that there are situations where once all the facts are known about a transaction, we suggest steps to help protect the potential clients and ourselves. As in this case, we suggested using an attorney and using the contract approved by the Columbus Bar Association and the Columbus Realtors. We know that sometimes people need help even when they think they do not and that is why we made the suggestions we did. It seems that the buyer did not understand that these suggestions were for her protection. Furthermore, she did not seem to appreciate our suggestions or fully understand the complexity of a transaction where the buyer is out of state and will not be attending the closing in person, and all that involves. Ultimately, we made the decision that we were not the right title agency for her and suggested she find another one to close her transaction. It is unfortunate that after spending the time and providing the advice, for no fee whatsoever, that she felt it appropriate to provide the review she did. Certainly, her attempt to impugn our honesty was uncalled for and inappropriate. If anything, we were totally upfront and direct in all communications."
