pursue this in small claims countOn the evening of 10/13/2012, I used Ms. Hall's valet Service at La
Fograta Grill located at 790 N. High St. Columbus, OH 43215  (614)
294-7656.  The vehicle (2007 Audi A6) was transferred to the valet on
duty & the valet fee was paid.  Upon returning from dinner, I was
informed that there was a "problem" with the vehicle and that it had a
flat tire.  The valet claimed no responsibility.  Upon inspection, it
became apparent that the side of the tire was blown out & there was a
cut in the vehicle rim. My spouse and I were forced to take a cab back
to their residence. The next morning, the plaintiff returned to the lot
where the valet had parked the car.  Several pictures were taken of the
tire and rim damage, the tire was replaced & I returned home.  I
visited two tire shops who stated that there was a high probability that
the vehicle struck a curb or another object to sustain such damage.  I
immediately reached out the owner of the valet company, Pamela Hall,
& emailed her the pictures of the damage.  In her email response on
10/17 she stated "After reviewing your pictures, we are offering to
repair or replace your tire."  Since then, I have not received a
response from Ms. Hall and her insurance company has declined to cover
it due to her high deductible.
I want ms. Hall to pay for the damage to the rim and tire replacement.  Also the cab fare home that evening. I am hoping that this can be resolved amicably.  If not, I will be forced to file a suit in small claims court, and file a complaint with the BBB and the Ohio Attorney General's Office.
Response from Local Valet Service LLC
"The member's accusations are incorrect and false. When he dropped off his car, my attendant called me immediately. He explained to me that the tire was going flat, I instructed him to find the member and make him aware of it. He called me back 20 minutes later and could not find him. At 2:00am he returned for his car. My attendant explained to him that his tire was flat. My attendant offered to change the tire for him. He did not have a jack in his car. At that point, he said that it wasn't a "big deal" and that he would return in the morning to get the car. We offered to pay for his taxi ride home, and he left. I did receive a call and a few emails from him. I immediately offered to replace his tire and again pay for his taxi. I gave him our office address and asked him to send me the receipts for his tire that we would happily reimburse him for the cost. He then sent me an email stating that he wanted his rim fixed as well. I told him at this point, I felt it was in my best interest to contact our Insurance provider. Upon doing so, Our Insurance Agent came out and investigated the premise of the property. He assured myself and the member that it was not possible that this happened at our lot or in our care. My Insurance Agent had been in touch with him numerous times via email and phone calls. After he continued to "add up" charges, My Insurance Provider suggested that I no longer try to rectify the situation. On the Claim Ticket that was given to him it clearly states that " All vehicles are parked at owners risk, and that NO Liability is assumed by us". The disclaimer goes on but, that is the premise of it. I do feel that it was more then generous for me to offer to replace his tire and pay for his cab fare. We refunded his parking money and did not charge him an overnight parking fee. My Insurance provider suggested that he claim it with his Insurance provider and they would counter us, meaning we would replace his tire in the same condition, he choose not to do that. So, If he would like to pursue this further with Small Claims Court as he has stated, We are more then ready to counter his claim. I consider his claim to be false, slander, and negative publicity. He should have taken our offer and this would have been settled."
