I won the lawsuit against Marvin Mosher of Orion Homes and Orion Roofing and Remodeling. He told Charlotte BBB that he was no longer in business, however; I checked with Rowan Co. and the business license is still good..... Mr. Marvin Mosher is a crook!

I am not happy with the progress and the fact that the contractor is trying to get more money out of me for him underestimating the job. Now, I have a wall at the back of the house which is down and cracks in my kitchen, breakfast nook and the bedroom. Plus, steps that should be condemned, back storm door out of alignment and a crack in the wall on the left of the house near the wall they rebuilt. They have caused more problem than they repaired. I am not happy with the results and the fact that he is not coming to finish the work. I have contacted my attorney who will be sending a letter to the contractor if work is not completed by the date stated in the contract. 9/7/2010 - I noticed the the kitchen floor and breakfast room floor were looking like they were prior to the contractor jacking them up. So, I got my level and checked and sure enough; the floors are slanted again.. The window in the breakfast room is lopsided, the back window in the bedroom on the back will not push down enough to lock the window, plus the window seal is cracked. The main beam runs down the middle of the house and everything to the left of the main support beam is slanted to the left of the beam. This is new and the is now a dip in the roof at the back of the house near the pitch in the roof. I called my attorney and he stated that from what he knew, jacking up a house took months, not weeks, just for the very reason I am have all the problems with the house now. I sent a letter to Marvin Mosher regarding all the issues I have on 9/8/2010 and called him the day before. I have not heard from Mr. Mosher to date. According to the contract with USDA, Mr. Mosher has 30 days to respond to my requests and the house has a one year guarantee on the work from Mr. Mosher. Given the fact that Mr. Mosher was trying to get more money out of me prior to completing the job, I seriously doubt that I will hear from him. I am prepared to sue him in court for the cost of the repairs. Mr. Mosher never informed me of the fact that jacking up a house would cause other problems. He was too interested in getting his hands on the money. 9/19/2010 - Went under the house to take pictures for my attorney and found out why the floor is sinking under the kitchen as it was before, there are no metal supports on that side at all. Evidently, the metal support they had incorporated into the brick outside wall, they took down when they had to tear down the wall and did not replace it. This is really a bad job all the way around. All the loose broken brick that was suppose to be hauled away was stuffed in the hole by the brick wall and covered over with sand. When I watered my plants, all the sand washed away to find the broken bricks and mortar in the holes. I have pictures of all of this and to date have yet to hear from Mr. Marvin Mosher. Mr. Mosher has until October 8, 2010 to answer my letter, if at that time I have not received a response, I will contact my attorney. Mr. Mosher never responded to my letter. 11/22/10 - My attorney sent him a letter of demand for the amount of money it would take to repair the damage and the inferior job his worked did to my home. The dateline for him to answer was 11/18/10. He never responded. Therefore; I will have to file a lawsuit against him in court. Please do not do business with this man or his company. He will just close down the company and start another one. On 11/30/2010 - I filed a complaint with the Better Business Bureau of Charlotte, Case #415854, on 12/13/10, they noted on response to their first notice, on 12/21/10, they noted no response to their second notice. These responses were sent via email and on 12/21/10 a third notice was sent via mail/fax. This week or possibly next week I will have all of my information and pictures together to file a small claims case against Marvin Mosher and his sub contractor, Telesforo (Tele) Acosta. 1/5/2011 - I filed a complaint with the Better Business Bureau in Charlotte, NC. They tried several to contact Marvin Mosher to no avail, finally on 12/30/2010; I received an email from them stating they had not received any response from Marvin and they were closing the case. However; they would leave my complaint on their website. On 1/4/2010, I received another email from BBB stating they had a response from Marvin. He stated I would not pay anymore money for the extra work they did that was not included in the contract. I responded to his state regarding extra work. The fact that his workers caused cracks in my wall and floor separating from the baseboards by 2". That was work he was responsible for as my walls were fine until they starting jacking up the house in the back. Now, the living room floor is dropping down from the baseboards by at least 2" as well. I am afraid the entire house is going to collapse because of his inexperienced workers not know how to jack up a house. Plus the fact that the wall he build at the back of the house will not support the house because of lack of sufficient mortar and the fact that the metal support beam do not have lag bolts to keep them secure, nor are the beam sitting on cement supports. They are in the ground and if the house sinks, it will push the supports into the ground. Therefore, the supports serve no purpose. It is a waste of money. Marvin stated his business Orion Homes in no longer in business, well I already new that. He started a new business, it was Orion Roofing and Remodeling, but that to is evidently out of business. I saw a website, but you can not fine it now on the Internet. I was told by the contractor who inspected his work that he could close his old business and start another one by just paying $125.00. I guess that is what he has done. I have not found out if there is another business he as started or not. I am sure he is a savvy con man. At this point I have been trying to file a small claims case against him and the sub contractor Telesforo Acosta, however; North Carlina makes it hard for an individual to collect any money. Even though the work was done in Richmond Co. where I live, I have to sue where the individuals live! That means I will have to file my case in Rowan Co. and another in Cabarras Co., which means I will have to pay $85 for each county I file in. $70 for the court and $15 for the Sheriff's Dept. to serve each individual. Now, I have to pay more money and I am not assured of getting anything, even if I win the case. I did find out if he does not pay, I can file a Writ of Execution, which means I can contact the Sheriff's Dept to take items that will equal the value of what he owes me. Maybe there is some justice. 3/16/2011 - I drove to Salisbury, NC to the Rowan Co. Small Claims Court for the Small Claims case I filed against Marvin Mosher. I presented my case and gave the Judge a notebook full of pictures of all the inferior work and he took no time in awarding me the $5,000 I was suing for from Marvin Mosher, who did not even show up to court. I would not either, if I had take the money and life a person's home the way he did mine. Thank you GOD!!! I won!!! Now, on the the Sub-contractor Telesforo (Tele) Acosta. He is trying to avoid being served, but I am sure they will catch up with him soon. The next court date is 4/13/2011. He had a chance to go on Judge Mathis' show, but he did not, must have something to hide. The show would have paid the judgment, but if the case is heard here, he pays out of his pocket.
