In April 2022, my wife paid Conley Construction a substantial $58,198 deposit as per a contract to build a house for my parents-in-law. The contract clearly outlined costs and plans in a statement of work. At the time, our land was in the process of being subdivided, a detail Conley was aware of and acknowledged that construction could not commence until subdivision was completed. In January 2023, after successfully completing the subdivision, we promptly notified Conley so construction could begin. However, by July 2023, no construction had started. Conley then informed us that the project would cost significantly more than initially estimated, presenting us with a choice to either accept the increased cost or cancel. We could not afford the escalated price, so regrettably, we chose to cancel the project. Following the cancellation, a mediation session in March 2024, mandated by our contract, aimed to agree on a refundable amount of our deposit. Despite this requirement, Conley refused to negotiate during mediation, resulting in its failure. During mediation Conley refused to return any amount of our deposit. As of today, Conley Construction has retained the full $58,198 deposit, despite failing to commence any construction or provide any starter materials. It's important to note that our contract did NOT specify the deposit as non-refundable, only as payment for starter materials. Based on our experience, I strongly advise against engaging in any business with Conley Construction. While we've had positive dealings with other contractors, dealing with Conley Construction has been a deeply disappointing and costly mistake. Please exercise caution and avoid falling victim to a similar situation.
