On September 10, 2007, I signed a contract with David Glenn, Western Services, Shell Knob, MO., for the construction of an addition to my house. David Glenn started the construction and received payments of approximately $124,000, over about next three or four months. During the construction, damage was done to the existing house and many things were done improperly causing rework. David's shoddy work and constant mention of "more money" caused us to cancel elective work that had allowances on them. This reduced the amount of what we owed on the final bill. Upon receiving the last large draw, David quit and walked off the job on 1/11/08. While the subcontractors did come back and complete their portion of the work, David left without finishing items on the contract that he was responsible for such as repairing damages to our existing home, fixing work that was done wrong, cleaning up the property and rough grade the yard. Many items that were spelled out in the spec sheet of the prints were simply not done at all. To date, I still have a roof that leaks and a basement that cannot be finished due to leaks around the fireplace. My request for lien wavers, after Dave quit and "breeched" the contract, was met with a bill for additional money. The last bill was for about $2800. We back-billed David Glenn for $19,663.60 which covers repairs, materials and our personal labor, at David's labor rates, to complete the unfinished work and repair the damages to our house that he left us with. After sending a letter from an attorney requesting lien wavers and getting only a bill in response, I sent another letter requesting lien wavers and restitution for unfinished/faulty work. Not being able to get a satisfactory response from David, I filed a complaint with the Missouri Attorney General Consumer Fraud Department in early April. This case number is CF-2008-12215. To date, the only response has been a letter dated Oct.9, 2008 from David's attorney asking for more time. I have a complete file of all the information, original contract, picture files, receipts, print package all detailing the errors and unfinished work and overcharges that was sent to the consumer fraud office and is available to anyone needing more detailed information on this matter. David lied about the services he would provide. This includes many items in the contract as well as the ones he made verbally while trying to get us to sign the contract. I contend that he quit to avoid the expense of finishing work he was responsible for after receiving his last large payment. His only defense till now has been to keep bringing up the last small payment that in fact would have ended up being money owed back to me. Denying us lien wavers after we paid him that much money and him QUITTING is simply extortion. If we had needed to secure a loan to pay for the house we would have been forced to pay him his final bill no matter how much he left unfinished or damaged.

While they did build the addition it was a constant struggle to make sure things were done properly and a constant struggle dealing with the owner David Glenn and his short cuts. According to one sub, David low balled allowances on a lot of the work to get the price down to get the job. He intended to make up the difference by charging extras on a lot of things. Having a construction background is the only thing that prevented us from sustaining a larger loss on this project that there is now. David got mad and quit leaving a lot of unfinished work from both promises he made to get the contract, but also a lot of work that was on the prints and in the spec sheet. David walked out on a signed contract but insisted on even more money after he quit and to date is still holding lien wavers for the project as hostage. Anyone dealing with David Glenn should hire a contractor surveillance person to keep watch over him and his subs, not pay him anything in advance until the work is completed, and get money from him put into an escrow account to cover loses from work done wrong. David broke promises, broke a signed contract, lied, and took payment for work he did not intend to finish. To date we have been billed for $2,800 for the final draw of the contract David voided/quit/breached. We have been denied lien wavers. We have back-billed Western Services for $19,663.60 for labor, equipment rental, material and damages. This is to finish work David took money for but did not complete, correct work done incorrectly, and for labor done during the construction that had to be done but David refused to do. We are still experiencing roof leaks. We have filed a complaint with the Missouri Attorney Generals Consumer Fraud office and have still had no response from Western Services.
