"The member and I had a verbal agreement over the phone. We agreed that I was going to show up to do the job on Friday. The member was very pleasant; we had a great conversation. She expressed how thankful she was that I came out to her house promptly for an estimate. The following day, we had a phone conversation. I agreed to cut her shrubs and clean out her plant beds, a service we normally don't do. She was fine with the price and gave me the go ahead. I put her on the schedule. I did not think much about the signature on the contract. We have had verbal agreements with other neighborhood clients. I have not had this problem. Given the facts, the member was present when the sod installers arrived at her residence. Installers have Sod-X uniforms. The sod truck that was present at this jobsite has an advertisement signage of 4x16 (bold letters) on each side of the truck with Sod-X name, phone number and website. When the job was completed, the member told the installers, "they did a beautiful job" and expressed "how satisfied she was." For the record, the installers speak and understand English very well. What transpired overnight, I have no idea. Other than I didn't have a signed contract, which in turn, does not benefit me or the company. It does not make any sense for the company Sod-X to go out to a jobsite with equipment, sod and payroll and hope we get paid. There's much involved and a huge investment for Sod-X to contemplate. If the member did not want us to do this job, a courtesy call would have been greatly appreciated and this all could have been prevented. I would have withdrawn the crew from this jobsite immediately. It was definitely visible to the eye that Sod-X was on her property. Sod-X does not practice showing up to people's houses just to get a job. Absolutely not!! We are very professional and very involved in our community. On the member's estimate/contract we did not require a down deposit to get the job started. We take full payment when the job is completed and we have met the expectations of our customers. Furthermore, we have a 60-day warranty on our sod installations. I find it very hard to believe that the member will allow our workers to start and continue the job if she had another contract with another company that she gave $115.00 deposit down. No is a universal statement in any and all languages. No is no. In reference to her comment that the crew did not speak English. In good faith, the member should submit the cashed deposit check along with the contract of this other company that she said she hired. We will take the $300 with the proof of these documents. If no proof of cash deposit check, we will match the estimate that was offered by the other "A" vendor. We regret that this incident ever happened and will require written consent going forward on all scheduled work, no matter how urgent or anxious the customer request. - Rico Del Rio, Owner"
