"Federal Law requires we give our clients 3 days to cancel. We do this n our contract and on a separate form which we did. The form explains how to cancel and the time frame in which it must be done. The member canceled way out of the recession period. We are entitled to 15% of the agreement which is 2625.00, we began processing all the paperwork, secured financing for the homeowner and paid our representative. We incurred costs on this project even though no windows were installed. The deposit was for 2000.00 and we are entitled to 2,625.00. We would have considered canceling the agreement had the financial hardship been proven. But the consumer states that the reason they didn’t send in the cancellation on time was due to the fact they were on vacation. Just because windows were not made, doesn’t mean we don’t have costs associated with the project. We have policys in place to protect our clients and we must follow them. We are the largest Impact window provider in the state of Florida and the forms on how to cancel the agreement were left with the client and were clear."
Per a difficult HOA, attempts for a resolution between me, my HOA and STW continue to be long and strained with the HOA's issues on the grid pattern, length of the screens and frames.
Since 11/11/13, there have been 15 communication efforts to STW (email, phone messages and direct discussions) in my attempts to seek STW assistance and offer a resolution to my HOA. There were 2 visits from STW Installation Mgr. (Brad), 3 conversations with STW President (Lee) and 5 communications with my HOA. As recommended by Brad at STW, I offered a resolution to 2 of the 3 issues to the HOA, and the HOA has not accepted the offer. The relationship is strained between the 3 parties: STW feels they did their job by installing the windows per HOA approval (STW will not agree to remove the windows as requested by my HOA); HOA is not in agreement to the look of the windows and feel the ARB approval conditions have not been met, and I feel that David (STW rep who visited my home) was not forthright with me on what to expect from the windows nor do I feel he paid attention to the HOA requirements when recommending the STW product. David did not have a sample product to show me, just a photo of the window, no details of the screens or frames. As I said earlier, I trusted David's expertise. Also, the master bedroom window is defective, one of the side windows does not open (since the installation).
As of 1/28/14, my conversation with STW President (Lee) was strained and unpleasant but the take away was that STW will send me a resolution proposal to submit to my HOA. I have not yet paid STW the balance due payment (approx. $3600).
Additionally, STW's installers did some damage to my windows sills and wood flooring, and Lee agreed to repair the sills and floor. I am still hopeful there will be a mutually agreeable resolution between the 3 parties for the windows.
