"Mr. [member name removed] held an ECM Bronze Level A/C Maintenance Plan. The terms and conditions of the contract plan indicate that "service is provided during normal business hours, Monday through Saturday, 8am to 5pm." The terms also provide that "service will be based upon the level of priority, service demand and the availability of technicians." Mr. [member name removed] contacted ECM on a Sunday at 2pm in the afternoon. Although emergency service is available after business hours at overtime rates, emergency service is only available based on ECM's available technicians which are provided based on demand for service. On Sunday, April 21, 2013, most of the Greater West Palm Beach area was experiencing warmer than expected temperatures and as such ECM's on-call and emergency technicians were overloaded and could not respond immediately to all customers. Mr. [member name removed] was offered to have a technician scheduled for his home first thing on Monday morning and declined the offer. In researching further information from Mr. [member name removed] about his phone conversation, he indicated that the representative he spoke to did not explain the high demand/high call volume to him and that the representative made it seem that service would not be provided to him on an emergency basis because he was a contract holder. ECM regrets that members of our staff may fall short of our expectations to fully respond in clear detail to our customers especially during high pressure times so that they may understand extenuating circumstances that create a situation where we may fall short of their service expectations. Unfortunately, we cannot change the communication Mr. [member name removed] experienced, but we have counseled our representatives accordingly based on this event and we have honored Mr. [member name removed] request for a full refund of his original contract price."
