Escrow agent (at the 2890 E Skyline Drive office, Tucson)failed to disburse funds to us as Sellers on time, and allowed Buyers to access the home before the Deed had even been recorded. Refused to show us any documentation that might show the facts about why they paid later than agreed, and would not offer any refund or other compensation for their failure to meet escrow conditions competently.

In April of 2008 I sold my Oro Valley Arizona home to an all cash buyer. I owned the home free and clear, so the process was very smooth. The deed was recorded into the buyers name. The money owed to me was wired into my account, or so I thought. I called my bank repeatedly, looking for the money. I was told repeatedly no incoming wire had arrived. I checked and rechecked the routing and account numbers. The bank information I provided to my title company was correct. I was horrified, as the property was recorded into the buyer's name by now. I called my escrow officer and asked how she could track the wire. She began a process called back tracing. She learned that the written authorization to wire the funds got stuck in the fax machine in the accounting department of the title company, Title Security Agency of Arizona. The money arrived in my account one day after it should have. I was not buying another house on the back of this sale. If I was, this mistake would have put the second escrow process in immediate jeopardy. I contacted the Chief Operating Officer, Lori Schroeder. I explained to her they lost a large amount of my money for 24 hours, causing my wife and I extreme emotional distress. I asked for $500 damages. Lori Schroeder was cold, condescending and standoffish. She said "We didn't do anything illegal or unethical". She also said: "You got your money, what's the problem?" The problem, Miss Schroeder, is that, for whatever reason, you have no time, energy or desire to consider how your behavior and the conduct of your company affect your customers. Miss Schroeder, you made it clear to me, by how you treated me on the phone, that you simply didn't care how I felt, or how I was affected. $500 is a very reasonable amount of compensation for the work and anguish your company caused my wife and I. Miss Schroeder, you gave me $50. You owe me $450. The standard process of "choosing" a title company, for a purchase or sale, is to use the one that is handed to you. I have learned to put as much consideration into the choice of a title company as I do the house I am buying or selling. It's just that important.
