DO NOT SIGN ANY CONTRACT WITH THIS REALTOR I have found that all Mr Turner, of Napier Realtor wants from buyers is to get you to sign a contract with them so that they can sue you for work they did NOT perform Last year (2013) I called with Bryan Turner, of Napier Realtors/ERA on the phone, explaining to him that my fiancee & I wanted to buy a home here in Midlothian. We exchanged a phone call or two, then some e-mails. I tried to explain to Mr Turner what we were interested in 1st floor living, since both my fiancee (Denise) and I have back problems and due to our age (I was 61, she was 54). After he told me that there would not be much to show, I even accepted that he could show us other kinds of property. The properties he sent me (via e-mail) about 75 homes he had us feeling that we would not find a home. When we met Mr Turner and he immediately gave us a contract to sign. When Mr Turner showed us the contract, he stated that the time frame (one year) was to protect him from us waiting to come back and cheating him out of his commission, and that if we got to the point where we could no longer work together, we could go our own way. Since up until this time, Mr Turner seemed to be trustworthy, in ?good faith? we signed the contract, feeling that he should be protected concerning the WORK he would do for us. He also stated that if someone didn?t wish to work with him, he would release them from the contract. We were willing to and did see any kind of home, new and re-sales properties that Mr Turner came up with. While I kept telling Mr Turner that we did not want to see homes in particular areas, he kept sending us these properties. Also, when we would talk about why he was showing us homes in certain areas, he would remark about the better schools, while we would respond that schools were NOT an issue with us. And while we did say we would look at homes which were not set up as 1st floor living, we did so to see if we could alter these homes to fit our requirements. With one new construction home that Mr Turner showed us, he told us he could have the builder add another room on it for a reasonable price. While that would have made that house better for us, it still had other issues. Since none of they were what we wanted, we did wish to part ways with Mr Turner. Since this will be Denise?s and mine last house, we were not going to settle on what Mr Turner wanted to sell us. After seeing the homes Mr Turner would show us and having Mr Turner keep telling us that what we wanted was not available, I felt that we should part company, yet Mr Turner refuses to part ways. Because of Mr Turner insisting that what we wanted was not on the market here in Virginia, we started to look at homes on our own and in fact, Denise found an ADVERTISEMENT for a home which could meet our requirements in the ?Guide to Chesterfield 2013 magazine? page 15. This home was for about $320,000 while the homes Mr Turner was showing us went up to and included $400,000 homes. This housing area has been on Midlothian since 2005, and yet Mr Turner claims he did not know about it! When I told Mr Turner that he missed this, he told me I HAD TO work with him if we would buy this. (We did not buy this home.) When I mentioned that to Mr Napier, he also told me that I should have told Mr Turner about it. I thought a Real Estate professional should know his/her area, what is available, etc and know what kind of questions he/she should ask potential buyers. I tried to explain to James Napier and ERA that Mr Turner is accusing us of trying to steal his commission, something I not only feel insulted by but I do feel he is ?libeling us.? In a response, Mr Napier agrees with Mr Turner, thus he too is ?Libeling us.? Mr Napier stated that because of the ?contract? we are obligated to discuss ANY home we find with Mr Turner. Mr Turner & Mr Napier could have set up appointments to show us homes which we may have found acceptable. Let us say, every Saturday until July 2014 they would have 10 homes to show, this way they could have ?earned? their commission, but instead, they are doing nothing to EARN the commission, and threatening us with a law suit if we buy a home in Virginia without paying them a commission. As I told the Napier Realtor, and the ERA office, I would feel Mr Turner is owed a commission for any of the homes ?he informed us of,? but why would he deserve a commission for something he did not tell us about, while it was available, or could it be that he has a problem with this developer? The contract we signed, in good faith, was to protect him for the WORK HE DID FOR US. Because of this, Denise and I stopped looking to buy a home, since we refuse to pay anyone for work NOT DONE. In late 2013, we again tried to find a solution (via an attorney) but Mr Naiper?s attorneys stated that they would sue us for the full commission on any home we purchased in Virginia UNLESS we agreed to pay $1,000 to Mr Turner and legal fees. I did contact ERA National Headquarter but as of this date, still have not heard back from them. I am UPDATING this report because the time frame of the contract is almost up.
Description of Work: DO NOT SIGN ANY CONTRACT WITH THIS REALTOR They were suppose to show us home to buy, instead they get you to sign a contract with them. Then they won't show you anything you want and if you try to find something on your own, they will ask for a commission. AND, they are very quick to tell you they WILL SUE you if you don't pay them. Because of this, I was not able to buy a home for the last year!
