He offered a 39 day guarantee to sell our house, else the listing woul be free instaed of 39 days. After the 39 days I asked if we were now at 3% instead of instead of 6 %. He said no. My understanding was they only way guaranteed was voided was if an offer came in within 5% of the list price then I would have to accept it or the guarantee would be void. Part of is selling taktic is to lower the list price every week or so by up to 2 percent. After 10 days it was lowere 2 % after 20 it was lowered 2 % more. I called him on this and told him I would not accept less than 95% of the list price. Shortly after it was at 95 %. The 5% rule was on the reduced list price not the original list price. So I had voided the 39 day guarantee. If I would have known this up front(it was not listed on the page he gave me describing the 39 day guarantee I would have never signed. The way I see it is that if it would sell where I would agree in the 39 days then both would be happy, but if it goes past the 39 days, they would continue to list it but could just keep lowering the price. I had told them before signing that I needed to get a certain amout out of the house so the list price that we agreed on was enough that if I did get an offer that was 5% low I would still get that amount. I did not understand that after 39 days my list price could be over 9% less than when we started. This dies not make any sense. If a buyer that likes the house after say 35 days may buy it for the original list price, but if it already lowered by 10%, the won't offer the full 100%. It is only when the selling market is REALLY good would someone offfer more and then only if they were bidding against someone else. If you talk to them make sure the put in writing(signed by them) a LIST of all the ways the guarantee can be voided by the seller before you sign the contract. Not buried in some other document(s).
