The house that I rented from Andy Gibson and Keys to the Lake was unsafe and uninhabitable. As a single mom of 4, I had been incredibly direct, honest, exuberantly communicative and at times, very emotional and angry toward Andy and Keys to the Lake, yet with very good reason. After repeatedly notifying Andy and Keys that there was an emergency leak in my bathroom and mold appearing on the ceiling of a bedroom below, they continued to not acknowledge or address either of those problems. They allowed one repairman to come and wipe the mold off the ceiling with a bleach solution and tell me that the leak was too "insignificant" to repair. He then informed me it was safe for me and my children to move back in. I refused. I am incredibly smart, resourceful and extremely protective of the health and well-being of my kids, as any good mom would and should be. After providing Keys with the results of a mold test and a report furnished by a professional home inspector, specifically saying "substantial mold growth in the concealed space between the main-level floor and the basement-level ceiling cannot be eliminated, and the presence of mold in the air has been confirmed. The basement ceiling should be opened to expose the concealed space, determine the extent of probable mold growth and moisture damage, and make necessary repairs.", still nothing was done. Days after receiving this mold report from me (5, if I'm not mistaken), someone showed up at the home I rented, without my prior knowledge or consent, to allegedly make all necessary repairs: "Lake Area General Maintenance repaired your showerhead and the ceiling issues downstairs today. At this time, the owners feel all of the necessary repairs have been made, and the home is available for you to move back into. They are not willing to compensate you for any lost time out of the property." So, what I observed on the evening of Tuesday, June 25, in the home I had lived in prior to June 10, was a little spackle in some nail holes that Repairman #1 had poked in the ceiling downstairs when he wiped the mold down. I also observed that the toilet seat in the bathroom had been left up. Beyond that, nothing further had been done. Upon closer examination, turning on the shower head upstairs still elicited a leak from the ceiling down below. Granted, the leak did take a few minutes longer to drip as the nail holes had been spackled over. No drywall had been opened up anywhere. Anyone can deduce that there has to still be mold and moisture between the two floors of that home. Any reasonable person should not have to ask for help and emergency, necessary repairs and wait for 16 days and two "repair people" to come into the home and NOT fix either of the two issues that I had explicitly and specifically made them aware of. It was made clear to me that Keys and Andy didn't work on the weekends and that they wouldn't contact the homeowners on the weekends. My children and I had not easily or conveniently had access to our thing or our home for 6 weeks before we finally settled and were released from our lease in small claims court! I lived in an unsafe environment, with my 4 children, for potentially 2 1/2 months. I invested a great deal of my personal money to upgrade the cleanliness and hygiene of that home to make it suitable for my family. I will never get that back. I certainly didn't move into the house intending there to be mold and a leak that would be ignored by two repairman. It also really added insult to injury to receive a call from Keys to the Lake on Tuesday, June 25, telling me that a late fee had been added, and that my June rent was past due. I paid my rent in their office personally, and spoke to Andy Gibson himself, as I handed over the check, on June 3! The check cashed on my bank on June 6. Andy apologized for the "accounting error". Under normal circumstances, that could be easily forgiven. Under my current circumstances, trying to collect double rent plus a late fee on a home that isn't even suitable to live in is ludicrous!! Mark Krants, owner of Keys, stated in our small claims hearing, that his business was not responsible for what my family and I had been through as there was no mention of mold or a leak on our move in inspection report. I'm not going to comment further on that statement as it speaks for itself, except to say that the house had also not been lived in for about 6 months prior to our moving in. This mean no water had been run for that entire time, although I believe the mold and leak had been present long before that. I would be glad to elaborate on any or all of this information, should anyone have any questions of me. Thank you!
Description of Work: The house that I am renting from you and Keys to the Lake remains unsafe and uninhabitable. We are still bouncing around to various friends and places in limbo with no answers or remedies. I am frustrated beyond reason, and as a single mom of 4, I feel I have been incredibly direct, honest, exuberantly communicative and at ti ... mes, very emotional and angry, yet with very good reason. I can't imagine that even you could or would continue to argue with me after reading what I am about to say, and knowing that it is true. After repeatedly notifying you that there was an emergency leak in my bathroom and mold appearing on the ceiling of a bedroom below, you continue to not acknowledge or address either of those problems. You allowed one repairman to come and wipe the mold off the ceiling with a bleach solution and tell me that the leak was too "insignificant" to repair (the insignificant is his word, not yours, but that is what he said to me). He then informed me it was safe for me and my children to move back in. As you know, I refused. I am incredibly smart, resourceful and extremely protective of the health and well-being of my kids, as any good mom would and should be. After providing you with the results of a mold test and a report furnished by a professional home inspector, specifically saying "substantial mold growth in the concealed space between the main-level floor and the basement-level ceiling cannot be eliminated, and the presence of mold in the air has been confirmed. They are not willing to compensate you for any lost time out of the property." So, what I observed on the evening of Tuesday, June 25, in the home I had lived in prior to June 10, was a little spackle in some nail holes that Cody poked in the ceiling downstairs when he wiped the mold down. I also observed that the toilet seat in the bathroom had been left up. Beyond that, nothing further had been done. Upon closer examination, turning on the shower head upstairs still elicits a leak from the ceiling down below. Granted, the leak did take a few minutes longer to drip as the nail holes had been spackled over. No drywall had been opened up anywhere. Andy, anyone can deduce that there has to still be mold and moisture between the two floors of that home. Andy, any reasonable person should not have to ask for help and emergency, necessary repairs and wait for 16 days and two "repair people" to come into the home and not fix either of the two issues that I had explicitly and specifically made you aware of. Yes, you made it clear that you don't work on the weekends and that you won't contact the homeowners on the weekends. No offense intended, but who cares? My children and I have not easily or conveniently had access to our thing or our home for 16 days!!!! I am giving you one last and final chance. I have met with my lawyer and he recommends I pursue you in small claims court. I'm willing to do that, but I also realize that it's expensive, and a serious hassle for both of us. I don't easily have the time, energy or finances, but that is exactly what I will do, if necessary. Your last option is to reimburse me June's rent and my entire security deposit and pet deposit totalling $1900. I lived in an unsafe environment for potentially 2 1/2 months, and have not spent more than a few minutes at a time, with a mask on to gather a few things, since June 10. I am still paying the electric bill and trash service for a home I don't live in. I have invested so much more than all of that to upgrade the cleanliness and hygiene of the home to make it suitable for my family. I will never get that back. My dog has never been inside the house, only out, and I certainly didn't move into the house intending there to be mold and a leak that would be ignored by two repairman. I would like you to assure me of how and when that $1900 will be returned to me (in a timely manner), or I will contact the media and file a small claims case within the next 48 hours. It also really added insult to injury to receive a call from your office on Tuesday, June 25, telling me that a late fee had been added, and my June rent was past due. I paid my rent in your office personally, and spoke to you as I handed over the check, on June 3! The check cashed on my bank on June 6. You apologized for the "accounting error". Under normal circumstances, that could be easily forgiven. Under my current circumstances, trying to collect double rent plus a late fee on a home that isn't even suitable to live in is ludicrous!! I am only doing what I have to do to protect my family. I would hope you would do the same for yours!
