I emailed a written complaint to Murney Associates, and to Turner Residential Properties (the home builder and Kerry Turner's husband), stating that it was unethical business practice to accept our offer, with no intention of honoring it. They basically responded that it is their duty to get the best price, and the agreement isn't legal until the papers are signed. i.e. a Text agreement doesn't count because it's not legally recognized. I completely understand that we have no legal recourse, but it was the Murney agent Kerry Turner who countered our written offer via TEXT. I really have to question why she didn't formalize the counter offers, unless she knowingly does this to leverage the legal loophole of TEXTing. I can only speculate of course, but the end result is that she didn't do the paperwork, and then completely disregarded our agreement when she got a better deal. She certainly leveraged the texting loophole with us, and again, while it may be legal, it is not ethical business practice to broker agreements that are not honored. I have also filed a complaint with the BBB, and I intend to share our experience wherever I can so that others can avoid this kind of bad experience. TEXTing is a major form of communication and Missouri needs to recognize how this is being misused and close the loophold that allows professional people to do this kind of thing.
Description of Work: We submitted a written offer to purchase real estate thru our agent, to Murney Associates agent Kerry Turner. Kerry Turner countered via TEXT, and after several counters on both sides, all via TEXT, the Murney agent Kerry Turner accepted our offer via TEXT. She said she would send the written counter to us for the agreed upon price. Kerry Turner did not send the written counter, and 24 hours later told us that they had accepted another offer. We had her TEXTed acceptance of our offer, but since a TEXT isn't legally binding in Missouri, she was legally free to accept another offer. It might be legal, but it isn't an ethical way to do business.
