We began to have problems almost right away, once we gave him the first installment on the system. We could not reach him by phone, he did not return phone calls, and did not answer his cellphone (when the mailbox was not full). We wanted to find out the estimated time on the installation of the outside unit so that we could schedule interior contractors. It took several weeks just to get a return phone call. When he finally called, he stated that he had been in court and could not be reached. We expressed our displeasure with his customer service, and were assured that it would not happen again, and he scheduled an appointment to set the outside unit and get the temporary heat turned on. That day came and no Mr. Wilcher. We received a phone call, several hours after he was scheduled to arrive, from his wife (who is his receptionist) that he had been in an auto accident and our outside unit had been damaged during the accident. That he would be in touch shortly. That occurred in late December. After many, many many attempts we finally received a phone call from his employee, around the first of February. We attempted several times to have the unit set before a major snow storm, nope, didn't happen. After the snowstorm, we informed them that either we had the unit set or we would find a new contractor. We still had not heard from Mr. Wilcher, and we didn't hear from him until late March. We did eventually hear from Mr Wilcher, with a litany of excuses, (His child was in the hospital, his dog ate his homework and other equally stupid statements) He apologized profusely, and would be up in the next few days to finish the job. He did do that. Around the end of April, we came home on a Sunday evening, to find that it was "raining" in our kitchen. The unit, which had just been inspected 2 weeks prior by Mr. Wilcher, was leaking into the attic floor and had damaged our kitchen ceiling. We attempted to call, no answer on either cellphone or on workline. Bottomline, it was our fault, that the drainline got clogged and he refused to assist us. We turned this into our homeowner's insurance. It was fixed at our expense. We tried mediation, to rectify this situation, He agreed to pay our deductable, finish the installation work and agreed to be available for any service issues. He did pay the deductible, but never finished the instillation and was not available when we had a problem in December (on the coldest day of the year). We came home in December, to find that our heat was not working. Now, keep in mind , the unit is only 8 months old at this point. We could not get in touch with Mr. Wilcher. We eventually called another contractor. He came to fix the unit, he walked into the attic, took one look at the system, and said that we needed to call the state inspector immediately! We did that, we also called several other contractors to evaluate the system. They all said the same thing.....Worst installation they had ever seen, hands down. Worst designed system, ever seen, hands down. We felt we had no recourse but to sue to Mr. Wilcher. We retained the services of an attorney. He attempted to mediate the situation. Mr. Wilcher returned his letter, stating that it was all our fault and he would welcome a lawsuit. We went to court, and won our suit! The judge tried to mediate, and get Mr. Wilcher, to settle with us. He refused and we received a judgement of 16,400.00 We were very happy, for a while. Several weeks later we were informed, that Mr. Wilcher, instead of trying to work out payment arrangements, declared bankruptcy. We asked about his liability insurance, only to be told that "faulty construction" was not covered in his liability insurance. The bottom line is we are out approximately $30,000.00, between attorney's fees and the judgement money.
Description of Work: We hired this contractror to install HVAC in our new home. We checked his references, met with him on several occassions prior to hiring him and then gave him the contract to work in our new home.
