DO NOT USE - AVOID AT ALL COST I was contacted about an estimate for tuckpointing my Chimney in March which I gave clear instructions I was NOT ready to have the work performed. I was given no written estimate, did not give a deposit, did not call asking for the work to be done I got home from work 2 months later to find he went ahead and did the work without my knowledge or permission also to find a voicemail from him promptly after it was done asking for payment. Not only was I extremely mad this guy did work on my house without my permission his workmanship is beyond sloppy. -There was no attempt to match the pointing grout to the color of the rest of my house-No attempt to use the same type of recessed tuckpointing style like the rest of my house-Debris left all over my roof-Debris left on my lawn and behind plants-Mortar dropped on my Unilock patio causing permanent staining Overall sloppy sloppy job When I confronted him about not calling ahead and the sloppy job he did he got all defensive and belligerent and said I don't know anything about tuckpointing and came up with every excuse in the book from his son still learning to his daughter getting married and needing money. With such a messy sloppy job I have to now hire a company to rip out his work and re do it as Tomich Exteriors does not have proper insurance to compensate me for his sloppy, unauthorized work he did when he trespassed on my property. His insurance company was out to look at the work he performed and even the adjuster agreed it was sloppy, poor workmanship
Description of Work: In March 2012 Tom Tomich gave a verbal price to me over the phone to tuckpoint my chimney. I did not accept the proposal and told him not to do the work. He showed up any way in early May 2012 without calling me, me signing a contract, or in any way accepting his verbal estimate and proceed to trespass on my property and mearily smeer masonary mortar not even color matching my existing mortar on my chimney and side of my house in a sloppy, poor quality manner. Not only is his “Tuckpointing” work sloppy and of poor quality. He made a complete mess of my brick walkway with dropped grout and he discarded dried cement on my lawn as well as leaving debris and dried mortar all over my 2 year old roof.

I received your letter with the enclosed complaint from the member and would like to clarify a few of his allegations. To begin with, he is a previous customer. He approached me a year ago when I was doing spot tuck pointing work on a building a few blocks away from his house. He asked for a business card and said he had a rental property in the city and wanted to know if I could give him an estimate for tuck pointing the chimney and spot tuck pointing the base of the building since it was a (2) story frame house. I said yes, then did so, sent him a written estimate, he agreed to the price for the work, said go ahead and we did the work. He was satisfied with it, and then paid the amount in full by check. When I went to pick up the check at his home (he taped it to the front door) I noticed his chimney needed tuck pointing. I called him to tell him I got the check and let him know that his chimney needed to be tuck pointed, for about the same amount as the estimate on his rental property ($250.00) (see enclosed estimate /contact sheet #3000. He indicated that he would like to have the work done the following year (2012). About a month or so later, I encountered him at a local street festival where he once again thanked me for the nice work on his rental property and assured me he would like to have the tuck pointing done on his home the following year. I called him in early April of 2012 as a fellow up call that I make to all my customers that have asked for estimated the previous year to see if they are ready to have their work done. He said he would like to get the work done after May 1st, and needed additional spot tuck pointing to the rest of the building (sides and back) where old down sports used to be. I indicated that additional cost should be no more than $50.00 Since he was a previous customer, and since the work to be performed on his house was almost identical to that performed on his rental property and for the same price. I kept my notes for his tuck pointing of his house chimney in the top Morgin……………… I put a notation “go ahead after May 1St Thursday call first (?) When I hadn’t heard from him by May 9th I don’t remember if I attempted to call him before I began the work, but I felt that I had been given approval to go ahead with the work, through on last phone conversation. I did the tuck pointing of his chimney on his home on May 9, 2012 while my son, Matthew, did the spot tuck pointing on the remainder of the building (2 sides and rear). I checked out the loose/deteriorating mortar, then tuck pointed the chimney sold (completely) roofline to cap, repaired/reformed damaged/discolored/spalled brink faces with colored mortar to match same, recoated the concrete chimney cap with a coat of mortar, then sealed the chimney roof line to cap with a close preserving seales. Motor color was matched to within one shade of building mortar color/ sampled applied for color matching before work began. After I completed tuck pointing the chimney, I gently removed mortar droppings from the roof with the side of my tuck pointing towel, brushed off any remaining residue with my hand held brush then washed down the area around the chimney with (3 ) gallons of clean water brought with us on the truck. My son also cleaned below the work areas he was spot tuck pointing. We removed our equipment and left. I called him to inform him that the work he requested was done and if he could leave me a check for $250.00 the next day. The next day, Friday, May 10th, we were working (2) doors away from him for a neighbor who requested to have his chimney tuck pointed and building spot tuck pointed as were finishing work on he arrived home and approached the house where I was working, called to me and said he hadn’t given me approval to go ahead with the work on his house. I told him that I would be over in a few minutes since I was just finishing work on his neighbor’s chimney. When I concluded my business with his neighbor and went over to his house, he indicated that he did not like the decorative swirls that I had applied to his chimney cap and wanted them removed. Also, he felt the spot tuck pointing wasn’t smooth enough to blend in with the adjacent previous work. I told him that I would return on Monday to adjust the discrepancies with the work and would like a deposit of $125.00 in the intern. He said he wouldn’t give me a deposit until the swirls were removed from his chimney up. I was tired. We had just tuck pointed a chimney which took the entire day. (His neighbor thought he needed to have his chimney rebuilt – $500.00 – $1000.00 I told him I could save it tuck point it solid/refaced spalled backs plus chimney cap, install screened metal chimney cap, seal chimney and spot up bed for @250.00 We did it. He paid us. Then asked for an estimate on a rental property he owned in the city. Happy Guy? Now he is complaining about the decorative swirls which I did on his full house using “artistic license” since I thought it would enhance the look. The customer is always right! Right? So, I took off my 10ft ladders from the trick raised them up to his roof, climbed up the ladders, scraped off the swirls from his chimney cap then recoated that area with left over matching mortar from his neighbor's job, he seemed satisfied. He then game me a check for $125.00 (See enclosed copy) as a down payment (ie. Payment for chimney) and I agreed to come back Monday and touch up the spot tuck pointing and clean any mortar color from his bush going way walk to his satisfaction. He agreed to his. On Monday May 13th Morning as I was preparing to leave for work at his house, he called me and said that he did not want me on his property and that I used my mortar straight from the bag! (without adding any color) I told him that I used (3) colors in my mortar and that showed me how much he knew about tuck pointing. I felt at that time that our business relationship had ended. He had paid me $125.00 by check for the work done on his chimney and was not willing to allow me to touch up the spot tuck pointing on his building. Apparently, he was going to keep the other $125.00 balance and have someone else to touch it up or let nature smooth the mortar joints over time. Unfortunately, this story does not end here. A few days later, when I was checking balance on my bank account. I noticed a debit for $125.00 plus a 12.00 service charge. I was puzzled by this entry until I received a notice from my back the following day that the check he had given me for deposit May 10th had on been returned due to a stop payment request by him on May 11th. I felt dismayed that I had accepted his check in good faith as partial payment for work that we had performed on his house only have it returned for non- payment. Also, that he had reneged on his agreement to allow us to return and touch up the spot tuck pointing on his house. Furthermore, he accused me of using sub-standard methods and materials. I am still willing to do the touch up work on the spot tuck pointing on the back and sides of his house and clean off any mortar color from his going away walkway as per our original agreement. But before I would be able to do this work, I would need a restitutions payment of the $125.00 he originally gave me for a down payment. (i.e. tuck pointing of chimney plus the $12.00 check return fee (cash or cashiers check only). This check indicated accept once and approval of our work. Others than that, as far as I am concerned, my business relationship with him is at a conclusion. Any future dealings with him will be in the form of punitive legal action in Small Claims Court to recoup the $267.00 owed for the work done on his house and prosecution for theft of services of wanting a check then stopping payment as per advice of my legal counsel. IT TOOK HIM A LITTLE LONGER THAN OTHERS TO GET BACK WITH ME BUT HE IS A ONE MAN SHOW AND I CAN UNDERSTAND THE DELAY. HE WAS A VERY NICE FELLOW. HE QUOTED ME MORE THAN OTHER COMPANIES.
