The stager the agent hired was contributed absolutely no value. She handed me 12 pages of notes that said to declutter, which i had already told her upfront that i needed to do. I ended up staging my entire home, and the realtor handed me a bill from the stager for hanging art that we rented and that my husband had to help her hang. When we got an offer on the first day we were on the market that was $50K less than our asking price, the realtor pressured us to take the offer saying it was "only" $50K less. It was only $600 less in commission for her so she wanted to close the deal $50K less for us. I made her call one of the other people that had also seen the house on the first day because I knew they were interested. In the end, I held steadfast to my price, and I got my full asking price. When the buyers walked away, I had to constantly hound her to get our earnest money signed over. When the house went back on the market, I asked for those marketing brochures she said she had on the first day we were on the market, but every time I asked, I got a different answer that made it very clear to us she lied and never had anything printed. When a buyer came in unrepresented, the reatlor declared that she had "procured" the buyer and insisted that she was "entitled" to the entire commission when in fact, our buyers found our home on Zillow. Our buyer had discounted the buyer's commission. We tried to negotiate with the realtor with reasonable request, and she would not hear anything of it. Then after a call with our agent and our buyer where they had agreed to not get a home inspection, and in return, we would give them the inspection report from the previous buyer, which we provided everything that she requested. Then on the same evening, without consulting us, she called our buyer and told them to get their own home inspection, which then costed us another $2500 from the Inspection Resolution. In addition, she shared confidential information, without our permission, with others including the real estate agent for our first buyer. She shared with our the exact amount of her commission and the purchase price of our new home. She had also shared unsolicited private and confidential informaiton about the purchase of one of her other clients to me. Based on all of these problems, we contacted Tony Carnesi, owner of Keller Williams DTC, to inform him of the problems with were having with one of his agents, he told me he would look into the situation and call me back. Needlessly to say, he never called me back. Instead, I got an email from the reatlor saying that I would be dealing with another agent in the office. Luckily, my buyers contacted me to ask if I was aware that he was informed that although I would be dealing with another agent, but that my buyers would continue dealing with the Jane Turnock. That information was never relayed to me nor discussed with me by Tony Carnesi or anyone from Keller Williams. At that point, I contacted my lawyer to fire both Jane Turnock and Keller Williams DTC. In exchange for the reduced listing commission, we had promised to purchase our next home with Jane Turnock. While we were under contract with our first buyer, we began the house search. It because apparent very quickly that her search criteria had everything to do with her commission and not our search criteria. She sent us listing that were $100-$150K above our price range, and in areas that was no where near our interested areas. When we did find homes on our own that met our criteria, it would take several rerquests to her to get a showing scheduled. A coupld of days after my parents looked at a house for us while we were out of town that was a contender, she called us to inform us that there were two offers on the house. we told her that based on my parents feedback, we were not interested in placing an offer. She was persistent about us putting an above asking price offer and then cancel later if we do not like the house after seeing it. I had to finally yell at her that we were not interested in the house or jumping into a bidding war. When she was not finding what we were looking for, we informed her that our back up plan is to rent an apartment and take our time looking since we needed to get our son settled before school started. Here is the email response from her. Keep in mind that we never promised her commission on three homes even if that was her own personal goal. ------------------------------------------------------------------------ Dear **** and ******* Hope your vacation is going well given all the considerations going on for you in Denver. I will forward the inspection report to you as soon as I receive it. Timing is everything and your housing decisions have clear domino effects. I realize how important it is for you to make plans to go forward toward your new dream home site. I understand your financial considerations given the proposed pricing of the premiere building lot sites and lack of suitable properties available in Lowry for purchase. I fully support your decision to rent during this interim period. I understand that is a business decision that you and Jeremy have made after careful consideration. That said I do not work for myself. I have a contractual relationship with Keller Williams which includes a annual financial obligation threshold in addition to monthly fees. I am not at liberty to make decisions that impact the company without approval of my employing broker. Therefore any downward adjustment to under six percent must have prior approval of the employing broker and is strongly discouraged in the industry as it relates to a perceived diminished value of the realtors services. Agents are granted authorization on a case by case basis to reduce a commission rate to 5 percent with supporting reasons . The rationale I presented to my employing broker to offer you 4 percent was based on a three transactions agreement that we discussed prior to signing the listing contract. Per this unwritten understanding I did not enter a provision to the contract adjusting the commission rate should this agreement change. With this email I am requesting that you agree to amend our contract with a adjustment in the commission rate to 5 percent. I am continuing to work very hard in all aspects and I trust that I am demonstrating my value. I am committed to providing exceptional service to you during this selling and future building transactions while maintaining a positive relationship with my broker. As you are aware I will always be grateful to you for providing me the opportunity to start my career with listing your property. Given our like visions and collaborative work to showcase your property you are under contract in one day. I value your friendship and would have much preferred to have met with you in person to present this concern. All the best Jane -------------------------------------- When we found a property that would work for us, and put in an offer, she wanted us to put in cash offer, which we bluntly told her no. Then she informed us that the seller's agent requested copies of "verifiable funds" since we did not have our pre-qual letter. We provided enough to her to cover the 20% down payment that we put in the contract. However, two days later when we sent that to her to forward to the seller's agent, she requested statements from us to cover the entire purchase price. We told her no. Her response was we it was necessary in case we needed to go into the deal with all cash. When we reminded her that we would not do that, she said it was if cases we defaulted on our mortgage in the future. We told her that at that point, it was strictly between us and the bank. We realized at that point that she was on a fishing expedition of our finances. Given that she was and is still married to Michael Turnock, who was convicted for a $6M Ponzi scheme here in Denver, we called LifeLock right after we ended the phone call with her to put a fraud alert on both of our accounts, which we realized was necessary because when I followed up to see if she had forwarded the bank and investment statements for verifiable funds to the seller's agent, she informed me that he did not want them. It was confimation to us that she snooping into our finances. We a strong believers of Karma and holding to our words, we found a house and let her get the buyer's commission not because we trusted her, but we were in complete control for everything on the transaction, and it meant we kept our words even if she did not at any turn. We also still in the middle of our contract on our home and did not want to do anything to disrupt that. However, after death by a thousand cuts with this agent, we could not even resolve our issues with her through Keller Williams. In fact, we ended up dealing with a Keller Williams owner (Tony Carnesi) that had even less integrity and professionalism than Jane Turnock. We have bought and sold five homes, so we have dealt with enough realtor and real estate agencies. This was the first time we have ever worked with Jane Turnock and Keller Williams, and it will be the last! Also, hire an attorney to look over that listing contract. This is a large industry where the realtors have the upper hand, and the listing contracts are all on their favor. Be sure to negotiate the earnest money as they get 50% of if your buyers walk away. They may be entitled to all of the commission if your buyers are unrepresented, which is more likely to happen these days with the internet. Better yet, do the work in getting your house, and then find one of these agents who will list your home for $500-$1000.
Description of Work: This agent, on behalf of Keller Williams Denver Tech Center, was suppose to provide an experienced stager, put the home in the MLS, hire a professional photographer to photograph the home, print brochure for showings and open houses, and get us maximum value for our home. In addition, this real estate agent was suppose to keep our all of our informaiton confidential. In addition, she was suppose to find us a home within our price range in the areas we requested.
