Nobody should ever have to go through what Gale Caldwell and ERA put us through. We were misrepresented and lied to. After we notified ERA that we would not be willing to rent our house to the buyers, and postpone closing we began receiving intimidating phone calls based on lies. Gale Caldwell told me the sellers had managed to get the money to pay for the house from their retirement and that everything had already been approved and, furthermore, that the buyers would close on our house with cash, remove the contingency clause and sue us for each day we hadn't moved out. That never happened and I doubt the buyers talked to anyone about taking $180,000.00 out of their retirement. Regardless, she failed to mention that, in the contract, was a clause that allowed us out of the contract if we didn't agree to any new conditions. She is a preditor. She had one of her agents representing us, the sellers, and another agent representing the buyers. She stood to make double commission and when she saw the deal fall apart, she became nasty instead of helpful. She is dishonest and lacks no moral foundation. We still have not received the $2,500 earnest money from the contract, that our own agent told us we were owed. We have filed a complaint with the Real Estate Commission of Colorado, (branch of DORA), and the Better Business Bureau.
Description of Work: We hired Pat Bigley, an agent of Gayle Caldwell, to sell our house. What happened to us should never happen to anyone. Our agent sold us on a contract that was coming from another agent in the same office. BEWARE! We were never properly represented on the contract. We were consistently fighting our own agent, who actually called my husband to nag him to stop what he was doing to fix a leak in the toilet, as we were literally leaving for his mother's funeral. We were told that the deal from the buyers perspective was solid and that we should feel safe in signing a lease on a new home. We did, and later lost nearly $4000 in deposits. The buyers defaulted on the contract, and the broker, Gayle Caldwell, began calling me at work to intimidate us into selling our house under the condition that we rented to the sellers, (despite telling her we were not comfortable with these extra condidtions that were *way* outside the ordinary). Furthermore, she refuses to pay the $2,500.00 in earnest money that we were owed. We have filed a complaint with the Real Estate Commission of Colorado, (branch of DORA), and the Better Business Bureau.
