My elderly parents and I purchased a home in good faith for my family to live in. I became legally disabled due to a medical condition over four years ago and needed a safe place. Because of my disabling medical condition we had to be very careful about the home we purchased. We asked a lot of questions of the builder to make sure the home would be safe and my needs met. My condition was explained to them as was the importance that the house be safe. They assured us they could handle the requirements and their homes would fit what I needed to be safe. We moved here December 20th, 2014. I got sick immediately after moving in and my children and dogs started exhibiting symptoms within a few days. I notified the builder the day after moving in there was a horrible odor throughout the house. It smelled of petroleum products and had strong chemical scents. I was assured it was nothing and it would go away. Whenever the plumbing was used the smells were worse. Taking a shower smelled and felt like you were soaking in gasoline. After going back and forth the builder admitted they used a different kind of plumbing in my house, but did not bother to tell us about it. It is called PEX and is known for serious off gassing and when low quality PEX (dirty PEX) is used it can take over a year to fully off-gas. Meanwhile this makes the air quality in your home unsafe particularly anyone with lung/immune issues. We discussed at length with the builder all of our concerns and had them give us the different products they used to be researched for safety, but they neglected to tell us about these pipes. Had we known we would have never bought this house. Because everyone was getting so sick I had an air quality test done on the house. The VOC levels were in the severe range and both formaldehyde and mold were elevated above normal. How does a brand new home have a mold problem? We worked to make sure the VOC content of products used in the house were low or no VOC. I paid extra to have the house painted with a NO VOC paint and primer yet the VOC test clearly showed there were elevated VOC levels from paint. I notified the builder and they refuse to even acknowledge it. They also refuse to deal with the laundry list of construction issues the house has. I have given them the lists several times and over 4 months later they still will not acknowledge or mitigate any of the issues with the house. It is under warranty and they still refuse to fix things. 1. Issue: There is a strong odor/fumes in entire basement and it spreads throughout the house ? The fumes cause a long list of symptoms: burning in the eyes, nose, and throat, nausea, severe headaches, blurred vision, etc. 2. Issues: The basement is unusable after paying a fortune to have it finished. ? The smell coming from the utility room makes the basement unusable ? The ceiling vents do not warm the room and one of the vents cannot be closed it is installed in a way that makes it permanently open. . ? The vinyl was installed directly onto the concrete. I asked several times about a subfloor as that was part of the decision to have it done ahead of time instead of doing it ourselves. I was led to believe there would be one. This was a question I asked several times and was assured it would be fine. However it is not fine. I have vinyl installed directly on concrete, which if I had not specifically asked about a subfloor repeatedly would not be a problem, but I did and was led to believe there would be one. 3. Issue: The pipes - PEX ? The pipes have a definite smell that is backing up into the house from the drains causing the air quality to be dangerous. ? When running the water it smells like gasoline or a petroleum product. ? We cannot cook with or drink the water in the house so I now have to spend a fortune on bottled water. I have not found a filter that can get rid of the toxins/smells from the pipes. ? After a lot of research this seems to be standard when low grade PEX piping (dirty PEX) is used with fumes lasting up to a year or more and severely impacting the air/water quality of the home. 4. Issue: Smells and sounds from adjoining units ? First question I asked the builder was if I could hear/smell neighboring units. I was assured that I would not be able to hear/be affected by them or any of the products they happened to use and the smells and toxins would not come through the walls. I asked this question over and over at each step in the process. This was a lie. ? When we first moved in they were still (and still are) working on the adjoining units. It would be only natural to hear constructions noises, but we could hear singing, the radio, and conversations. ? Worse we could smell the products they used in the house. The fumes would come into my home after months of assurances this would never happen. For anyone this is annoying, being subjected to the scents your neighbors use, but for someone with a medical condition, particularly lung, it can cause illness, complications, and worse. ? The builder lied to get the sale. 5. Issue: Master bedroom ? The master bedroom does not stay warm/cold no matter what it is set to. ? There is a smell in the room especially my bathroom and closet that seems to be coming from the pipes. ? I can smell the neighboring units in my bathroom and closet. I was assured this would not be possible, but when someone uses a product in the adjoining house the fumes come into mine. 6. Issue: No heat in any of the bathrooms ? The bathrooms are frigid, particularly the master bath. The warmest it gets is in the low 60's and in the summer it is going to be sweltering. ? This is another thing that I asked from the beginning. I asked it repeatedly and was assured it would be fine and now I cannot get an answer as to why I was told all the bathrooms would have HVAC when they do not. 7. Issue: The floor ? The stairs: every single stair the flooring is bubbled and coming up. The flooring on all the stairs is loose due to improper installation. This makes the stairs slippery and treacherous. ? There are many bubbles and nail pops throughout the floors in the house. Some of the nail pops are actually pushing through the flooring and putting holes in it. Just in one 1 foot by 3 foot area there are more than 9 nail pops in the floor. The nails are pushing on the vinyl. This seems indicative of a bigger problem than just very poorly installed flooring. This is indicative of an actual construction problem. The entire house is full of floor nail pops. Basement: bubbles in the floor and obvious debris (can't be a nail pop it is a concrete floor) under the flooring that was not cleaned before installing the floor. There are large chunks pushing through the vinyl. ? The floors have places that are squishy where you can feel the boards giving as you walk by and also places where they make a loud cracking sound when you walk on them. This is not normal and is not something normally found in brand new construction. ? The master bedroom floor is completely uneven making furniture move and unstable. You feel it every time you walk through the room. It is not just a small bump. You can feel the edge of the boards pushing against the flooring. ? There is a cracking board in the corner of my room. If you stand on it you feel it move and it makes a loud creak/crack. 8. Issue: Appliances None of the appliances work. The builder told me I have to contact GE directly as they will not take care of the issues. ? Dishwasher has not worked since day 1 ? Stove seemed to work at first, but over time has heating issues ? Microwave: The brand new microwave is leaking radiation meaning there is something wrong with the seal. We do not use it often, but a brand new microwave should not have this problem. In addition, when it is used what used to take 1 minute to heat now takes 5 or more and most things just do not seem to heat at all. 9. Issue: The Paint ? The house tested positive for VOC's related to paint. I paid extra for VOC free paint and primer. ? Not all walls were sanded before painting. ? Large areas of wall that are not painted or you just see spots of color over the primer. ? Big chunks of debris in the paint. Seems no sanding or prep work was done before painting. 10. Issue: Three out of the four windows in the house were not installed properly 11. Issue: The lawn ? Graded/seeded a few weeks ago. I was told they would move my dog kennel and then put it back. ? The kennel was a temporary structure put there because the builder asked me not to fence it immediately. ? Since they did not seed that area, I now have an over 100 square feet of clay with no grading or seeding right directly in front of my patio even after they promised they would move it. 12. Issue: Kids rooms have smells and do not heat/cool properly. I have had to spend a fortune on air purifiers and water purifiers in order to try to mitigate some of the builder's negligence. My specialist will not allow me to start my medical treatment protocol due to the VOC, formaldehyde, and mold issues.
Description of Work: LET THE BUYER BEWARE! I bought a brand new home from this builder. They promised me a quality home that would be safe for my disability and they did not follow through. Not only that, but the overall quality of the house is subpar. They charged me for things that do not appear to have been done and will not respond when I request information. The house is also toxic (air quality tests to prove this). Now they refuse to mitigate any of the problems and will not get back with me about the problems with this house. I FEEL THIS BUILDER TAKES ADVANTAGE OF THE ELDERLY AND DISABLED. LET THE BUYER BEWARE!
