The wall was constructed during the water drawdown of Lake Winnisquam in the fall of 2010. The wall survived the winter of 2011, but collapsed in places during it's second winter season of 2012. The winter of 2012 was extremely mild and the lake never had a hard freeze as is typical. The wall collapsed in places and virtually all the beach sand washed into the lake as a result. Ambrose Marine said that the damage was not due to their construction even though the extremely costly wall didn't survive even two winters. They quoted us almost $3000 to repair the wall in addition to the $18,000 we had already paid. We reluctantly agreed and paid a 50% deposit to get the wall repaired before summer. Unfortunately, the repair work was poorly done. The wall looked nothing like the original, and it was still unstable in places. Smaller rocks were added to make the wall stronger, but they seemed to only wash into the lake. The work looked amateurish and ugly. Ambrose would not agree to fix the wall in kind to the original wall either structurally or aesthetically. We came to learn this would mean taking it down and reconstructing. Their repair was makeshift and we could not leave it like that given our total investment. Because of the shoddy workmanship, we got estimates from three other marine contractors to fix the wall. At this point we had spent nearly $20,000 and had an unstable and ugly wall that would never have survived another winter without collapsing entirely. All the new contractors agreed that the wall was never constructed properly in the first place. All said to repair it the right way it needed to be deconstructed completely. All agreed that the wall face was not built correctly to sustain ice damage. The face of the wall should be built on a slant so as to allow for the ice to move. Ambrose built our wall with a straight vertical face. All agreed too that the backfill was completely inadequate. Lastly and most importantly, all said that if they had built the wall and it was so badly damaged after only two years, they would have repaired the wall at no charge. They all said they stood behind their work. We contracted with a new contractor at a cost of $3800 to repair the wall. We contacted Ambrose Marine and Tobin Greer several times asking him to please refund our $1,344 deposit for repairs in light of everything. They refused. We gave them every opportunity to do the right thing but they would not refund the 1,344 which got us nothing and we should never have had to pay in the first place. Mr. Greer's response to our complaint recognizes the fact that his company's repair was "useable and secure." The idea that we did not give them the opportunity to come back and fix the wall to our liking in structure and aestetics is a moot point. They did their repair; were satisfied with the work they did; and had no intention of rebuilding the wall from scratch which is what we had to have done. How many chances were we going to give them to get it right? Clearly, their workmanship when they built the wall and when they repaired the wall spoke for itself. We could no longer spend good money after bad.
Description of Work: Ambrose Marine constructed a "perched beach" at our Lake Winnisquam property in the fall of 2010. We dealt with Tobin Greer who was very nice to work and accommodating. The wall and beach constructed "looked" very nice but the construction as we would learn was poorly done costing us thousands of dollars more than the original $18,000.

While I am genuinely sorry the reviewer feels dissatisfied, I would like to address some specific points of the complaint. As the reviewer mentions, the wall survived winter of 2011 but did sustain damage during winter of 2012 when there “was not a hard freeze as is typical.” The lack of such a hard freeze is in fact somewhat atypical and more damaging as the ice is more susceptible to movement and heaving. While most ice damage occurs in spring when the ice is able to be moved in large floes, winter of 2012 saw quite a bit of damage throughout the lakes region during the middle (not usual) of winter because the ice was so poorly formed and was therefore more susceptible to movement and therefore damage. Unfortunately, the reviewer’s wall was a victim of a great deal of ice being pushed into it which is a peril of lakeside construction of all types. When contacted about the damage, we met with the reviewer and offered to repair the damage for $2,754.00, which the reviewer agreed to pay. We offered our opinion that the damage was a result of nature and the reviewer accepted that this was a factor. In a normal situation the proposed repair would have actually cost quite a bit more, but to try to be accommodating we offered the above price and were on site prior to their requested deadline. We completed the repairs and the beach was useable and secure. There was an aesthetic difference but there is no way to rebuild a hand/machine laid wall with natural rock and have it look exactly the same. When the reviewer indicated they were not satisfied with the repairs, we offered to return in the fall when the lake level would be lower and we could have better access. At this point we had invoiced and received only the deposit/down payment of $1,377.00 (50% of contract price) and did not expect final payment until we had completed repairs to the reviewer’s satisfaction. The reviewer then decided that they were not going to allow us to perform further repairs and no longer wanted to us to work for them. While this is certainly within their rights, I feel this decision on the reviewer’s part nullifies their request for a refund. For one, we did in fact mobilize equipment, labor and material to the site and perform repair work per our contract with the reviewer (all while doing no damage to the recently landscaped and irrigated lawn which was a major concern of the reviewer). Secondly, we were willing to continue to work to satisfy the reviewer but were not permitted to do so. While it would have been well within our purview to invoice the final payment, we, again in an interest of good faith and accommodation, did not do so. Due to space limitations, I am not able to address every point the reviewer mentions nor I am able to add other information that may be pertinent, but I encourage anyone who has specific questions or concerns to contact me directly via phone or email. I am not unsympathetic to the reviewer’s feelings, nor do I harbor any ill will, but I do believe that Ambrose Marine has acted appropriately and fairly in light of the facts of the entire situation.
