My neighbor entered into a contract with Mr. James Smith of D & C Construction and because the prices were out of this world suggested I take a look at him. I should have known something was up with this guy when he called to cancel our first appointment due to an overlap with another potential client. Mr. Smith finally showed up to discuss the plans of a patio / deck which we were hoping to have finished by our Fourth of July / housewarming party. Mr. Smith sat with us to draw up the plans per our specifications and we finally agreed on a price. Mr. Smith asked then asked for a deposit to purchase the materials which I gave him my credit card number. I received a call from Mr. Smith two weeks later which he informed me the card had expired. I gave him the new information and that was the last time Mr. Smith contacted me. When I checked my online credit card statement I noticed several charges to my account for building materials but the charges were not to D and C Construction but to his suppliers using my credit card. I spoke with my neighbor and he was having problems with his project as well. They were told by Mr. Smith that his child was kidnapped and he would not be able to start the project. The next time they spoke with Mr. Smith, he told them he was on vacation. Needless to say, the July Forth deadline came and went so after giving Mr. Smith the benefit of the doubt, I decided to contact him myself. I was told my project was coming up that week and I informed Mr. Smith that if I did not see materials being delivered to my house by that weekend I was canceling my contract. The weekend came and went and I heard nothing from him. I called him that following Tuesday when after answered we were mysteriously cut off. I called Mr. Smith back only to continue going to voicemail. I left Mr. Smith a message that I wanted my deposit money returned. I contacted the building suppliers about the issue I was having with Mr. Smith and they informed me there was nothing they could do since the materials we signed and picked up from their warehouse using my credit card and name. Almost 7 months and no materials or further developments I decided to submit this report so no one else gets bitten by this snake especially since he continue to send out flyers in the neighborhood.
